APPRENTICE ELECTRICIANS - TRAINING - Amends existing law to require

  1                                        AN ACT
  2    RELATING TO LICENSING OF  ELECTRICAL  JOURNEYMEN;  AMENDING  SECTION  54-1007,
  3        IDAHO  CODE,  TO  REQUIRE CONTINUATION TRAINING OF APPRENTICE ELECTRICIANS
  4        WHO HAVE NOT TAKEN OR PASSED THE JOURNEYMAN'S EXAMINATION WITHIN TWO YEARS
  5        OF COMPLETING INSTRUCTIONAL TRAINING OR WHO HAVE NOT ADVANCED  IN  APPREN-
  6        TICESHIP  TRAINING FOR A PERIOD OF TWO YEARS AND TO AUTHORIZE THE ELECTRI-
  7        CAL BOARD TO ESTABLISH BY RULE REQUIREMENTS FOR CONTINUATION TRAINING.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 54-1007, Idaho Code, be, and the same  is  hereby
 10    amended to read as follows:
                                                                        
 11        54-1007.  ISSUANCE OF LICENSES -- RECIPROCITY. (1) The administrator shall
 12    issue  licenses  to such persons as have by examination shown themselves to be
 13    fit, competent and qualified to engage in the trade of journeyman electrician,
 14    specialty electrician or master electrician, and to such persons, firms, part-
 15    nerships, associations or corporations as have shown  themselves  to  be  fit,
 16    competent and qualified to engage in the business of electrical contracting or
 17    specialty electrical contracting.
 18        (2)  An   apprentice   electrician,   as  herein  defined,  may  take  the
 19    journeyman's examination if he has completed the required related  instruction
 20    for   electrical  apprentices  as  approved  by  the  Idaho  state  board  for
 21    professional-technical education and has worked the number of  hours  as  pre-
 22    scribed  by the Idaho electrical board, provided that for each such year he is
 23    claiming to have worked as an apprentice  electrician,  the  apprentice  shall
 24    have  been  registered  with the division of building safety as an apprentice,
 25    paid an apprentice registration fee, and submitted with his annual application
 26    for apprentice registration verification of employment, the number of instruc-
 27    tional hours completed and the number of hours worked.  The  electrical  board
 28    may,  by rule, fix the apprentice registration fee, in an amount not to exceed
 29    the costs of issuing apprentice registration certificates  and  enforcing  the
 30    apprentice registration provisions of this act, and may also by rule establish
 31    requirements  relative to the manner of verification of employment, the number
 32    of instructional hours completed, continuation  training  and  the  number  of
 33    hours worked.
 34        (a)  An apprentice who has completed the number of instructional hours and
 35        has  not taken or passed the journeyman's examination within two (2) years
 36        of completion of the instructional training hours, shall provide proof  of
 37        continuation training as set by rule of the electrical board.
 38        (b)  An  apprentice  who has not advanced in apprenticeship training for a
 39        period of two (2) years shall complete continuation  training  as  set  by
 40        rule of the electrical board.
 41        (3)  Any person who has worked in this state for a period of not less than
 42    two  (2) years and who has worked the number of hours as prescribed by rule of
 43    the board as a journeyman electrician shall  be  considered  as  qualified  to

  1    apply  for  a master electrician's license in this state. The Idaho electrical
  2    board, in establishing by rule the requirements  for  a  master  electrician's
  3    license,  shall  also take into account the applicant's performance as a jour-
  4    neyman electrician.
  5        (4)  Any person with out-of-state experience who has worked as a  journey-
  6    man  electrician  or  as  an  apprentice electrician, as herein defined, for a
  7    period of four (4) years, and who has met such other  requirements  as  estab-
  8    lished  by rule of the board, shall be considered  as qualified to apply for a
  9    journeyman electrician's license in this state.
 10        (5)  To the extent that other states which provide for  the  licensing  of
 11    electricians provide for similar action, the administrator, on the recommenda-
 12    tion  of  the  Idaho  electrical  board,  may  grant  licenses to electricians
 13    licensed by such other states, upon payment by the applicant of  the  required
 14    fee  and  upon furnishing proof to the board that the applicant has qualifica-
 15    tions at least equal to those provided herein for applicants for written exam-
 16    inations. Applicants who qualify for a license under this subsection  are  not
 17    required to take a written examination.
