  1                                        AN ACT
  2    RELATING TO THE IDAHO CODE COMMISSION; AMENDING SECTION 73-204, IDAHO CODE, TO
  3        PROVIDE THAT MEMBERS OF THE CODE COMMISSION'S COMPENSATION  SHALL  NOT  BE
  4        CONSIDERED  SALARY FOR PUBLIC EMPLOYEE RETIREMENT SYSTEM PURPOSES; DECLAR-
  5        ING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 73-204, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        73-204.  COMPENSATION  AND  EXPENSE  OF COMMISSION -- EMPLOYMENT OF ASSIS-
 10    TANCE. Each member of the commission shall receive  as  compensation  for  his
 11    services  the sum of twenty-five dollars ($25.00) for each day's attendance at
 12    a meeting and each day's performance of the duties of the commission and shall
 13    receive his actual and necessary expenses, incurred in performing  his  duties
 14    as  such commission. Payment of said compensation shall not be considered sal-
 15    ary as defined in section 59-1302(31), Idaho Code. The  commission  is  hereby
 16    authorized  to employ and fix the compensation of adequate legal, clerical and
 17    other assistance.
                                                                        
 18        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 19    declared to exist, this act shall be in full force and effect on and after its
 20    passage and approval, and retroactively to January 1, 2003.

                     STATEMENT OF PURPOSE
                               
                                          RS 12772
                               
                                  The legislation would remove the three (3) members of the
    Idaho Code Commission from PERSI. The Code Commission requests
    this bill in order for its members to meet IRS requirements
