  1                                        AN ACT
  2    RELATING TO CONTRACTS FOR SCHOOL  TRANSPORTATION;  AMENDING  SECTION  33-1510,
  3        IDAHO  CODE, TO AUTHORIZE RENEWAL OF AN EXISTING CONTRACT UNDER CONDITIONS
  4        SPECIFIED; AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 33-1510, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        33-1510.  CONTRACTS FOR TRANSPORTATION SERVICE. All contracts entered into
  9    by  boards of trustees for the transportation of pupils shall be in writing in
 10    a form approved by the state superintendent of public instruction. No contract
 11    shall be executed covering a period of time exceeding five (5)  years.  School
 12    districts shall advertise, bid and contract for all bus transportation service
 13    routes  at  a  single time, and contract with the lowest responsible bidder or
 14    bidders meeting the specifications; provided that, one (1) time only, a school
 15    district may renew a contract with the current contractor for a  term  not  to
 16    exceed  five  (5)  years  if the board determines after renegotiation with the
 17    contractor, that the terms are satisfactory to the district. In  the  event  a
 18    contract is renewed, no notice for bids shall be required.
 19        Before  entering  into  such contracts, the board of trustees shall invite
 20    bids by twice giving notice as provided in section 33-402 g., Idaho Code,  and
 21    shall award the contract to the lowest responsible bidder.
                                                                        
 22        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 23    declared to exist, this act shall be in full force and effect on and after its
 24    passage and approval.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

The purpose of this legislation is to allow school districts who
contract transportation services to be able to negotiate the
current contract for an additional five (5) years without going
through the bid process for one time only.
This legislation will allow a school district to eliminate the
time and expense of the bid process for the one time only,
providing the negotiation is successful.  It also provides the
contractor a longer period of time to amortize capital purchases.
                          FISCAL IMPACT
There is no fiscal impact to the General Fund.
