legislative finding; and to provide that the director of the Department of
Health and Welfare shall apply for a waiver of the federal Children's Health
Insurance Program in order to subsidize health care coverage for pregnant
women in Idaho who would otherwise qualify for funding based on income

  1                                        AN ACT
  2    RELATING TO ELIGIBILITY FOR HEALTH BENEFITS; AMENDING  CHAPTER  2,  TITLE  56,
  3        IDAHO  CODE,  BY THE ADDITION OF A NEW SECTION 56-209m, IDAHO CODE, TO SET
  4        FORTH A LEGISLATIVE FINDING AND  TO  PROVIDE  THAT  THE  DIRECTOR  OF  THE
  5        DEPARTMENT  OF  HEALTH AND WELFARE SHALL APPLY FOR A WAIVER OF THE FEDERAL
  6        CHILDREN'S HEALTH INSURANCE PROGRAM IN ORDER TO SUBSIDIZE HEALTH CARE COV-
  7        ERAGE FOR PREGNANT WOMEN IN IDAHO WHO WOULD OTHERWISE QUALIFY FOR  FUNDING
  8        BASED ON INCOME LIMITATIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Chapter  2,  Title  56, Idaho Code, be, and the same is
 11    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 12    ignated as Section 56-209m, Idaho Code, and to read as follows:
                                                                        
 13        56-209m.  CHILDREN'S  HEALTH INSURANCE PROGRAM (CHIP) ELIGIBILITY. (1) The
 14    legislature finds that it is important to protect the health of pregnant women
 15    and to promote the long-term health of babies by funding the prenatal care  of
 16    pregnant women through the children's health insurance program.
 17        (2)  The  director  of  the  department  of  health  and welfare is hereby
 18    directed to apply for a waiver or waivers of the federal title XXI  children's
 19    health  insurance program in order to subsidize health care coverage for preg-
 20    nant women in Idaho who would otherwise qualify for funding  based  on  income
 21    limitations.

                       STATEMENT OF PURPOSE
                             RS 12834
The purpose of this legislation is to direct the director of the
Department of Health and Welfare to apply for a waiver of the
federal regulations to allow coverage under CHIP to be expanded
to include prenatal coverage for pregnant women who meet the
programs income qualifiers.
                          FISCAL IMPACT
The State match for Medicaid is estimated be $1,320,508.40.  This
includes pregnancy related coverage consistent with the existing
Pregnant Women and Children (PWC) inclusive of post partum
coverage until the end of the month in which falls the 60th day
after delivery falls.
