1 AN ACT
2 RELATING TO DISCLOSURE OF CONTROLLED SUBSTANCE ABUSE; AMENDING THE HEADING FOR
3 CHAPTER 45, TITLE 54, IDAHO CODE, AS ADDED BY SECTION 1, CHAPTER 33, LAWS
4 OF 1998; AND AMENDING CHAPTER 46, TITLE 54, IDAHO CODE, BY THE ADDITION OF
5 A NEW SECTION 54-4605, IDAHO CODE, TO PROVIDE FOR THE DISCLOSURE TO PRO-
6 SPECTIVE EMPLOYERS OF INFORMATION RELATING TO THE CONTROLLED SUBSTANCE
7 ABUSE OF LICENSED PROVIDERS OR PERSONS WHO WILL BE EXPECTED TO HANDLE OR
8 DISPENSE CONTROLLED SUBSTANCES IN THE PROSPECTIVE EMPLOYMENT.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That the heading for Chapter 45, Title 54, Idaho Code, as
11 added by Section 1, Chapter 33, Laws of 1998, be, and the same is hereby
12 amended to read as follows:

14 PATIENT FREEDOM OF INFORMATION
15 SECTION 2. That Chapter 46, Title 54, Idaho Code, be, and the same is
16 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
17 ignated as Section 54-4605, Idaho Code, and to read as follows:
18 54-4605. DISCLOSURE OF CONTROLLED SUBSTANCE ABUSE. Notwithstanding any
19 other provision of law, any prospective employer of a provider or person who
20 is licensed pursuant to chapter 14, title 54, Idaho Code, and who is expected
21 to handle or dispense any controlled substance in the prospective employment
22 shall, before hiring such provider or person, request of the respective
23 licensing board, and upon such request the board shall furnish, any informa-
24 tion in the board's files pertaining to abuse by the provider or person of a
25 controlled substance. The prospective employer shall maintain the confidenti-
26 ality of such information and shall not disclose it to any other person or
27 entity without the prior written approval of the licensing board.
STATEMENT OF PURPOSE
RS 12821
The purpose of this legislation is to require a prospective
employer of someone who will handle or dispense controlled
substances to obtain any information a state licensing board has
with regard to the prospective employee's abuse of controlled
substances. The employer is required to request the information
and the prospective employee's licensing board is required to
supply it. This requirement only applies to a prospective
employee who will be handling or dispensing controlled substances
and is intended to prevent drug tampering and drug theft.
FISCAL IMPACT
No fiscal impact to the General Fund.
