  1                                        AN ACT
  2    RELATING TO THE BROADCAST OF EMERGENCY INFORMATION; AMENDING CHAPTER 3,  TITLE
  3        5, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 5-340, IDAHO CODE, TO PRO-
  4        VIDE FOR THE CIVIL IMMUNITY OF RADIO AND TELEVISION BROADCASTING ORGANIZA-
  5        TIONS PARTICIPATING IN THE AMBER ALERT SYSTEM.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  3,  Title  5,  Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 5-340, Idaho Code, and to read as follows:
                                                                        
 10        5-340.    IMMUNITY OF RADIO AND TELEVISION BROADCASTING ORGANIZATIONS PAR-
 11    TICIPATING IN THE AMBER ALERT SYSTEM. No cause of action shall  be  maintained
 12    for  civil  damages in any court of this state against any radio or television
 13    broadcast organization, or the employees,  officers,  directors,  managers  or
 14    agents of such radio or television broadcast organization, based on the broad-
 15    cast  of  information  supplied by state law enforcement officials pursuant to
 16    the voluntary broadcast notification  system  commonly  known  as  the  "Amber
 17    Alert," which is used to notify the public of missing or abducted children.

                       STATEMENT OF PURPOSE
                             RS 12970
The purpose of this legislation is to give immunity to
broadcasters when voluntarily using the "Amber Alert" system for
the purpose of finding kidnapped and abducted children.
