  1                                        AN ACT
  2    RELATING TO SCHOOL TEACHER CERTIFICATE  RECORDS  AND  FEES;  AMENDING  SECTION
  3        33-1205,  IDAHO  CODE, TO REVISE THE SCHEDULE OF FEES FOR TEACHER CERTIFI-
  4        CATES EFFECTIVE THROUGH DECEMBER 31, 2004, TO PROVIDE FOR CERTIFICATE  AND
  5        RELATED  FEES  AS SPECIFIED BY RULE OF THE STATE BOARD OF EDUCATION ON AND
  6        AFTER JANUARY 1, 2005, AND TO PLACE A LIMIT ON THE PORTION  OF  FEES  COL-
  7        LECTED THAT MAY BE USED BY THE DEPARTMENT TO DEFRAY COSTS TO THE OFFICE OF
  8        CERTIFICATION; AND DECLARING AN EMERGENCY.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 33-1205, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        33-1205.  CERTIFICATE RECORDS AND FEES. (1)  The state board of  education
 13    shall  cause  to  be  maintained  a record of all certificates issued, showing
 14    names, dates of issue and renewal, and if revoked, the date  thereof  and  the
 15    reason  therefor. A thirty-five dollar ($35.00) nonrefundable fee shall accom-
 16    pany each application for an original certificate  and  each  application  for
 17    renewal.  A  fifteen  dollar  ($15.00)  nonrefundable fee shall accompany each
 18    application for certificate changes that are processed subsequent to the issu-
 19    ance of the original or renewed certificate. a prekindergarten  through  grade
 20    twelve  (12)  certificate,  alternate  certificate,  change  in certificate or
 21    replacement as follows:
 22        (a)  Original certificate, all types, issued for five (5) years ..........

 24        (b)  Renewal certificate, all types, issued for five (5) years ... $ 75.00
 25        (c)  Alternate route certificate, all types, issued for one (1) year .....
 26        .................................................................. $100.00
 27        (d)  Additions or changes during the life of an existing certificate .....
 28        .................................................................. $ 25.00
 29        (e)  To replace an existing certificate .......................... $ 10.00
 30        (2)  The fees specified in subsection (1) of  this  section  shall  be  in
 31    effect  through  December  31, 2004. On and after January 1, 2005, certificate
 32    and related fees shall be as specified by rule of the state  board  of  educa-
 33    tion.
 34        (3)  The  fees  shall be used by the professional standards commission for
 35    payment of the reasonable expenses in performing its duties and  responsibili-
 36    ties  as  approved by the state board of education and a portion not more than
 37    thirty-three percent (33%) of the fees shall may be used by the state  depart-
 38    ment of education to partially defray the cost of the office of certification.
                                                                        
 39        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 40    declared to exist, this act shall be in full force and effect on and after its
 41    passage and approval.

                       STATEMENT OF PURPOSE

This legislation amends Section 33-1205 to increase the fees paid
for certification required to hold professional positions in
Idaho Public schools. This legislation also places a limit on the
portion of fees collected that may be used by the Department to
defray costs to the office of certification; and declaring an
emergency. 
                          FISCAL IMPACT
There is no increase in the expenditure of state general funds as
a result of this amendment.
