|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 296 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE LOTTERY; PROVIDING LEGISLATIVE INTENT; REPEALING SEC- 3 TIONS 67-7420 AND 67-7451, IDAHO CODE, RELATING TO CONTRACTS FOR MAJOR 4 PROCUREMENTS AND EXEMPTION FROM THE STATE PURCHASING LAW; AMENDING SECTION 5 67-7441, IDAHO CODE, TO PROVIDE A CORRECT CODE CITATION; AND DECLARING AN 6 EMERGENCY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. LEGISLATIVE INTENT. It is the intent of the Legislature in 9 enacting this act that the State Lottery comply with the state purchasing laws 10 as other state agencies are currently required to do. 11 SECTION 2. That Sections 67-7420 and 67-7451, Idaho Code, be, and the 12 same are hereby repealed. 13 SECTION 3. That Section 67-7441, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 67-7441. RECORDS. All papers, records, correspondence, communications and 16 proceedings of the Idaho state lottery and the commission shall be open to the 17 public except as otherwise provided by statute; provided, however, that busi- 18 ness records and information provided to the state lottery pursuant to sec- 19 tions 67-7412(8) and (9) and 67-74201(8) and (9), Idaho Code, shall be subject 20 to disclosure according to chapter 3, title 9, Idaho Code. 21 No lottery employee shall divulge or make known to any person in any man- 22 ner any information which is exempt from disclosure, whatsoever, obtained 23 directly or indirectly by him in the discharge of his duties, or permit any 24 copy thereof to be seen. Any employee violating provisions of this section 25 shall be guilty of a misdemeanor. 26 SECTION 4. An emergency existing therefor, which emergency is hereby 27 declared to exist, this act shall be in full force and effect on and after its 28 passage and approval.
