  2    RELATING TO CREATION OF A RURAL PHYSICIAN INCENTIVE PROGRAM; AMENDING  CHAPTER
  3        37,  TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-3723, IDAHO
  4        CODE, TO AUTHORIZE ASSESSMENT OF A FEE; AMENDING  CHAPTER  37,  TITLE  33,
  5        IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 33-3724, IDAHO CODE, TO PRO-
  6        VIDE FOR PAYMENTS FROM THE INCENTIVE FUND; AND AMENDING CHAPTER 37,  TITLE
  7        33,  IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 33-3725, IDAHO CODE, TO
  8        PROVIDE FOR PAYMENTS FROM THE FUND FOR RURAL PHYSICIAN INCENTIVES.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Chapter 37, Title 33, Idaho Code, be,  and  the  same  is
 11    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 12    ignated as Section 33-3723, Idaho Code, and to read as follows:
                                                                        
 13        33-3723.  RURAL PHYSICIAN INCENTIVE FEE ASSESSMENT.  The  state  board  of
 14    education  and board of regents of the university of Idaho may assess a fee to
 15    students preparing to be physicians in the fields of medicine  or  osteopathic
 16    medicine  who are supported by the state pursuant to an interstate compact for
 17    a professional education program in those fields, as those fields are  defined
 18    by  the  compact. The fee may not exceed an amount equal to eight percent (8%)
 19    of the annual individual medicine support fee paid by the state. The fee  must
 20    be  assessed  by the board and deposited in the rural physician incentive fund
 21    established in section 33-3724, Idaho Code.
                                                                        
 22        SECTION 2.  That Chapter 37, Title 33, Idaho Code, be,  and  the  same  is
 23    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 24    ignated as Section 33-3724, Idaho Code, and to read as follows:
                                                                        
 25        33-3724.  RURAL PHYSICIAN INCENTIVE FUND.  There  is  hereby  created  the
 26    rural  physician  incentive  fund in the state treasury. Money is payable into
 27    the fund as provided in section 33-3723, Idaho Code. Income  and  earnings  on
 28    the fund shall be returned to the fund. The state board of education and board
 29    of regents of the university of Idaho shall administer the fund as provided by
 30    section 33-3725, Idaho Code.
                                                                        
 31        SECTION  3.  That  Chapter  37,  Title 33, Idaho Code, be, and the same is
 32    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 33    ignated as Section 33-3725, Idaho Code, and to read as follows:
                                                                        
 34        33-3725.  INCENTIVE  PAYMENTS FROM FUND. The moneys in the rural physician
 35    incentive fund are hereby appropriated for the uses of  the  fund.  The  state
 36    board of education and board of regents of the university of Idaho may use the
 37    moneys to pay:
 38        (1)  The  educational  debts of rural physicians who practice in medically
 39    underserved areas of the state that demonstrate a need for assistance in  phy-

  1    sician recruitment; and
  2        (2)  The  expenses of administering the rural physician incentive program.
  3    The expenses of administering the program shall not exceed ten  percent  (10%)
  4    of the annual fees assessed pursuant to section 33-3723, Idaho Code.
  5        The  board  shall  establish  procedures  for determining the areas of the
  6    state that qualify for assistance in physician recruitment. An  eligible  area
  7    must  demonstrate  that  a physician shortage exists or that the area has been
  8    unsuccessful in recruiting physicians by other mechanisms.
  9        A physician from an area determined to be eligible under this section  may
 10    apply  to  the  board for payment of an educational debt directly related to a
 11    professional school. Physicians who have paid the fee  authorized  in  section
 12    33-3723,  Idaho  Code,  shall  be given a preference over other applicants. To
 13    receive the educational debt payments, the physician shall sign an annual con-
 14    tract with the board. The contract must provide that the physician  is  liable
 15    for the payments if the physician ceases to practice in the eligible area dur-
 16    ing the contract period.
 17        The  maximum amount of educational debt payment that a rural physician may
 18    receive is fifty thousand dollars ($50,000) over a five (5) year  period.  The
 19    board may structure the payment schedule to make greater payments in the later
 20    years.  The  amount  contractually  committed  in  a year shall not exceed the
 21    annual amount deposited in the rural physician incentive fund.

  2        On page 1 of the printed bill, in line 14, delete "and board of regents of
  3    the university of Idaho"; in line 18, delete "eight" and  insert:  "four"  and
  4    also  in  line  18,  delete  "8"  and  insert:  "4";  and  in  line 19, delete
  5    "individual" and insert: "average".
                                                                        
  6                               AMENDMENTS TO SECTION 2
  7        On page 1, in lines 28 and 29, delete "and board of regents of the univer-
  8    sity of Idaho"; and in line 30, following "Code." insert: "The state board  of
  9    education shall identify an oversight committee made up of knowledgeable indi-
 10    viduals or organizations to assist in the administration of this fund. Members
 11    of  this  oversight committee should come from the Idaho hospital association,
 12    Idaho medical association, office of rural health, Idaho rural  health  educa-
 13    tion  center,  medical  student program administrators and others as appropri-

 15                               AMENDMENTS TO SECTION 3
 16        On page 1, in line 36, delete "and board of regents of the  university  of
 17    Idaho";  and in line 38, following "practice" insert: "primary care medicine";
 18    and on page 2, in line 5, following "board" insert: ", through  the  oversight

 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  That  Chapter  37,  Title 33, Idaho Code, be, and the same is
 12    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 13    ignated as Section 33-3723, Idaho Code, and to read as follows:
                                                                        
 14        33-3723.  RURAL  PHYSICIAN  INCENTIVE  FEE  ASSESSMENT. The state board of
 15    education may assess a fee to students  preparing  to  be  physicians  in  the
 16    fields of medicine or osteopathic medicine who are supported by the state pur-
 17    suant  to  an interstate compact for a professional education program in those

 26    rural physician incentive fund in the state treasury. Money  is  payable  into
 27    the  fund  as  provided in section 33-3723, Idaho Code. Income and earnings on
 28    the fund shall be returned to the fund. The state  board  of  education  shall

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13059
     This bill will act as an incentive to cause doctors to want
to serve in rural communities when a need is demonstrated.
                          FISCAL IMPACT
     No fiscal impact to the General Fund.
