  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL
  3        YEAR 2004; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPRO-
  4        PRIATING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES; SETTING  PROVISIONS
  5        FOR  THE  REAPPROPRIATION OF CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES;
  6        AND EXPRESSING LEGISLATIVE INTENT REGARDING THE SHARING OF  FISCAL,  HUMAN
  7        RESOURCES  AND  INFORMATION  TECHNOLOGY  RESOURCES  WITH  THE  DIVISION OF
  8        PROFESSIONAL-TECHNICAL EDUCATION AND THE DIVISION OF VOCATIONAL  REHABILI-
  9        TATION.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  There  is hereby appropriated to the State Board of Education
 12    for the Office of the State Board of Education the  following  amounts  to  be
 13    expended according to the designated expense classes from the listed funds for
 14    the period July 1, 2003, through June 30, 2004:

 30        SECTION  2.  In accordance with Section 67-3519, Idaho Code, the agency is
 31    authorized no more than nineteen and four-tenths (19.4)  full-time  equivalent
 32    positions  at any point during the period July 1, 2003, through June 30, 2004,
 33    for the program specified in Section 1 of this act, unless specifically autho-
 34    rized by the Governor. The  Joint  Finance-Appropriations  Committee  will  be
 35    notified promptly of any increased positions so authorized.
                                                                        
 36        SECTION 3.  There is hereby reappropriated to the State Board of Education
 37    for  the  Office of the State Board of Education, subject to the provisions of
 38    Section 4 of this act, the unexpended and unencumbered balance of  any  appro-
 39    priation  contained  in  Section  1, Chapter 271, Laws of 2002, to be used for
 40    nonrecurring expenditures for the period July 1, 2003, through June 30, 2004.
                                                                        
 41        SECTION 4.  The reappropriation for the General  Fund  moneys  granted  in

  1    Section 3 of this act shall be subject to the following provisions:
  2        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
  3    June 30, 2003, is zero, the reappropriation for the  General  Fund  moneys  in
  4    Section 3 is hereby declared to be null and void.
  5        (2)  If  the  unexpended  and  unencumbered balance in the General Fund on
  6    June 30, 2003, is greater than zero but less than the total General  Fund  re-
  7    appropriation authority granted to all state agencies, that amount reappropri-
  8    ated in Section 3 of this act shall be in the proportion that the reappropria-
  9    tion for the Office of the State Board of Education bears to the total General
 10    Fund reappropriation authority granted to all state agencies.
                                                                        
 11        SECTION 5.  In order to promote administrative efficiency among the Office
 12    of the State Board of Education, Division of Professional-Technical Education,
 13    and  the Division of Vocational Rehabilitation, it is the intent of the Legis-
 14    lature that the fiscal, human resources and information  technology  resources
 15    funded  by  this  appropriation  be  shared with the Division of Professional-
 16    Technical Education and the Division  of  Vocational  Rehabilitation.  Sharing
 17    these  resources  shall not change the mission or purpose of the Office of the
 18    State Board of Education and shall not negatively affect its ability to  carry
 19    out its mission.

The FY 2004 appropriation for the Office of the State Board of Education includes a General Fund Permanent Base Reduction of $416,700.

In the Maintenance of Current Operations area, a total of $30,100 is included to cover Attorney General, State Treasurer and insurance fee increases for the coming fiscal year. No new funding was included for Personnel Cost Rollups, Inflationary Adjustments, Replacement Items or Change in Employee Compensation.

This appropriation represents a 7.1% or $386,600 decrease in General Fund money from last year’s original budget. The large decreases in dedicated and federal funds from the FY 2003 appropriation are due to grants expiring and spending authority being removed.

Intent language is included to limit the number of full-time equivalent positions, provide carryover from FY 2003 into FY 2004 for any unexpended and unencumbered moneys, and to allow the Office of the State Board of Education, the Division of Professional-Technical Education and the Division of Vocational Rehabilitation to share fiscal, human resources and information technology resources provided that such sharing does not negatively affect OSBE’s mission.
