1 AN ACT
2 RELATING TO APPROPRIATIONS FOR THE DEPARTMENT OF JUVENILE CORRECTIONS AND THE
3 IDAHO STATE POLICE; AMENDING SECTION 1, CHAPTER 324, LAWS OF 2002, TO
4 REDUCE THE APPROPRIATION TO THE DEPARTMENT OF JUVENILE CORRECTIONS; AMEND-
5 ING SECTION 2, CHAPTER 324, LAWS OF 2002, TO PROVIDE ADDITIONAL AUTHORIZED
6 FULL-TIME EQUIVALENT POSITIONS FOR THE DEPARTMENT OF JUVENILE CORRECTIONS;
7 APPROPRIATING ADDITIONAL MONEYS TO THE IDAHO STATE POLICE FOR FISCAL YEAR
8 2003; PROVIDING TRANSFERS TO THE PEACE OFFICER BENEFIT FUND; AND DECLARING
9 AN EMERGENCY.
10 Be It Enacted by the Legislature of the State of Idaho:
11 SECTION 1. That Section 1, Chapter 324, Laws of 2002, be, and the same is
12 hereby amended to read as follows:
13 SECTION 1. There is hereby appropriated to the Department of Juvenile
14 Corrections the following amounts to be expended for the designated programs
15 according to the designated expense classes from the listed funds for the
16 period July 1, 2002, through June 30, 2003:

35 SECTION 2. That Section 2, Chapter 324, Laws of 2002, be, and the same is
36 hereby amended to read as follows:
37 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Department
38 of Juvenile Corrections is authorized no more than three hundred forty-nine
39 fifty-three and seventy-five hundredths (349 353.75) full-time equivalent
40 positions at any point during the period July 1, 2002, through June 30, 2003,
41 for the programs specified in Section 1 of this act, unless specifically
42 authorized by the Governor. The Joint Finance-Appropriations Committee will be
43 notified promptly of any increased positions so authorized.
44 SECTION 3. In addition to the appropriation made in Section 1, Chapter
45 198, Laws of 2002, there is hereby appropriated to the Idaho State Police, the
46 following amount to be expended for the designated program according to the
47 designated expense class from the listed fund for the period July 1, 2002,
48 through June 30, 2003:

7 SECTION 4. The State Controller shall make cash transfers from the Gen-
8 eral Fund to the Peace Officer Benefit Fund, at the request of the Director of
9 the Idaho State Police, not to exceed $100,000, for the period July 1, 2002,
10 through June 30, 2003.
11 SECTION 5. An emergency existing therefor, which emergency is hereby
12 declared to exist, this act shall be in full force and effect on and after its
13 passage and approval.

This is a combined FY 2003 Supplemental Appropriation to the Department of Juvenile Corrections and the Idaho State Police.
 
| Fiscal Note |
This bill transfers $42,700 in General Funds from operating expenditures to personnel costs, and authorizes three FTPs so the agency can hire Safety/Security Officers for juvenile transports rather than contracting for services. The net impact of this transfer is zero.
Secondly, 1.75 FTPs were approved to provide substance abuse treatment for juveniles within the therapeutic community at the state facility at Lewiston. The agency was permitted to spend an additional $31,300 in federal funds, and in exchange, returned $17,200 from the General Fund for a treatment grant that had expired. The net impact of these changes is $14,100.
Thirdly, this bill appropriates $100,000 in General Funds to the Idaho State Police for a death benefit payment on behalf of a Department of Juvenile Corrections’ employee killed when the state plane crashed last year. The death benefit was approved by the Board of Examiners and a payment was made to the spouse of the safety/security officer during the interim. Under these circumstances, Idaho Code authorizes the issuance of a deficiency warrant. The source of the $100,000 in General Funds was from excess contract provider payments within the Institutions Program of the Department of Juvenile Corrections.
Note: This bill does not include the impact of a negative supplemental to deal with revenue shortfalls.
