APPROPRIATIONS - COLLEGES AND UNIVERSITIES - Appropriates $327,885,100 to
the State Board of Education and the Board of Regents of the University of
Idaho for Boise State University, Idaho State University, the University of
Idaho, Lewis-Clark State College, and the Office of the State Board of
Education for fiscal year 2004; provides legislative intent that $75,000 of
the amount appropriated be used by the Office of the State Board of
Education for system-wide needs; provides legislative intent that
$1,600,000 be used for matching awards, research centers and
infrastructure; provides legislative intent that $1,750,000 be used for
competitive technology grants, the Idaho electronic campus and for
participation in the Western Governors' Association's Virtual University;
provides intent that $500,000 be used for teacher preparation activities;
provides intent that $1,300,000 be used for the Governor's College and
University Excellence Initiative; requires a tracking and reporting system
for faculty, nonfaculty and classified staff turnover; reappropriates
unexpended and unencumbered fund balances; and provides legislative intent
regarding moneys received from outside sources.

1 AN ACT
2 APPROPRIATING MONEYS FOR GENERAL EDUCATION PROGRAMS AT BOISE STATE UNIVERSITY,
3 IDAHO STATE UNIVERSITY, LEWIS-CLARK STATE COLLEGE, THE UNIVERSITY OF IDAHO
4 AND FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL YEAR 2004;
5 LIMITING THE AMOUNT OF THE GENERAL FUND APPROPRIATION TO BE USED BY THE
6 OFFICE OF THE STATE BOARD OF EDUCATION; ESTABLISHING AN AMOUNT OF THE GEN-
7 ERAL FUND APPROPRIATION THAT IS TO BE EXPENDED FOR RESEARCH; ESTABLISHING
8 AN AMOUNT OF THE GENERAL FUND APPROPRIATION TO BE EXPENDED FOR COMPETITIVE
9 TECHNOLOGY GRANTS, AND FOR PARTICIPATION IN THE WESTERN GOVERNORS'
10 ASSOCIATION'S VIRTUAL UNIVERSITY AND THE IDAHO ELECTRONIC CAMPUS; ESTAB-
11 LISHING AN AMOUNT OF THE GENERAL FUND APPROPRIATION TO BE EXPENDED FOR
12 TEACHER PREPARATION ACTIVITIES; ESTABLISHING AN AMOUNT OF THE GENERAL FUND
13 APPROPRIATION TO BE EXPENDED FOR THE GOVERNOR'S COLLEGE AND UNIVERSITY
14 EXCELLENCE INITIATIVE; MAKING CERTAIN IDAHO CODE PROVISIONS SPECIFICALLY
15 AVAILABLE TO THE STATE BOARD OF EDUCATION AND THE BOARD OF REGENTS OF THE
16 UNIVERSITY OF IDAHO; REQUIRING THE STATE BOARD OF EDUCATION TO TRACK AND
17 REPORT FACULTY, NONFACULTY EXEMPT AND CLASSIFIED STAFF TURNOVER; REAPPRO-
18 PRIATING ANY UNEXPENDED AND UNENCUMBERED BALANCES; SETTING FORTH THE CON-
19 DITIONS FOR REAPPROPRIATION; DECLARING AN EMERGENCY AND PROVIDING AN
20 EFFECTIVE DATE.
21 Be It Enacted by the Legislature of the State of Idaho:
22 SECTION 1. There is hereby appropriated to the State Board of Education
23 and the Board of Regents of the University of Idaho for Boise State Univer-
24 sity, Idaho State University, Lewis-Clark State College, the University of
25 Idaho, and the Office of the State Board of Education the following amount, to
26 be expended for the designated programs from the listed funds for the period
27 July 1, 2003, through June 30, 2004:

40 SECTION 2. Of the amount appropriated from the General Fund in Section 1
41 of this act, an amount not to exceed $75,000 shall be used by the Office of
42 the State Board of Education for system-wide needs.

1 SECTION 3. Of the amount appropriated from the General Fund in Section 1
2 of this act, an amount not to exceed $1,600,000 may be used for matching
3 awards, research centers, and infrastructure, with commercial application as a
4 goal. The expenditure of these funds shall conform to the mission and goals of
5 the Higher Education Research Council.
6 SECTION 4. Of the amount appropriated from the General Fund in Section 1
7 of this act, an amount not to exceed $1,750,000 may be used for the competi-
8 tive Idaho Technology Incentive Grant Program to foster innovative learning
9 approaches using technology. These moneys shall also be used to develop,
10 enhance and promote the Idaho Electronic Campus, and for Idaho's participation
11 in the Western Governors' Association's Virtual University.
12 SECTION 5. Of the amount appropriated from the General Fund in Section 1
13 of this act, an amount not to exceed $500,000 may be used for teacher prepara-
14 tion activities associated with Idaho's Comprehensive Literacy Act as pre-
15 scribed in Section 33-1207A, Idaho Code.
16 SECTION 6. Of the amount appropriated from the General Fund in Section 1
17 of this act, an amount not to exceed $1,300,000 may be used for the Governor's
18 College and University Excellence Initiative.
19 SECTION 7. The provisions of Sections 67-3608, 67-3609, 67-3610 and
20 67-3611, Idaho Code, are hereby made available to the State Board of Education
21 and the Board of Regents of the University of Idaho for the period July 1,
22 2003, through June 30, 2004, the provisions of Section 67-3516(1), Idaho Code,
23 with respect to the Unrestricted Current Fund and Restricted Current Fund
24 only, and Section 67-3516(3) and (4), Idaho Code, notwithstanding.
25 SECTION 8. The State Board of Education shall establish a standardized
26 system for tracking and reporting meaningful data about faculty, nonfaculty
27 exempt, and classified staff turnover at the state's institutions of higher
28 education. These statistics shall be included with each year's higher educa-
29 tion appropriation request.
30 SECTION 9. There is hereby reappropriated to the State Board of Education
31 and the Board of Regents of the University of Idaho for Boise State Univer-
32 sity, Idaho State University, the University of Idaho, Lewis-Clark State Col-
33 lege, and the Office of the State Board of Education, subject to the provi-
34 sions of Section 10 of this act, the unexpended and unencumbered balance of
35 any appropriation contained in Section 1, Chapter 318, Laws of 2002, to be
36 used for nonrecurring expenditures, for the period July 1, 2003, through June
37 30, 2004.
38 SECTION 10. The reappropriation for the General Fund granted in Section 9
39 of this act shall be subject to the following provisions:
40 (1) If the unexpended and unencumbered balance in the General Fund on
41 June 30, 2003, is zero, the reappropriation for the General Fund in Section 9
42 of this act is hereby declared to be null and void.
43 (2) If the unexpended and unencumbered balance in the General Fund on
44 June 30, 2003, is greater than zero but less than the total General Fund re-
45 appropriation authority granted to all state agencies, that amount reappropri-
46 ated in Section 9 of this act shall be in the proportion that the reappropria-
47 tion for Boise State University, Idaho State University, the University of
48 Idaho, Lewis-Clark State College, and the Office of the State Board of Educa-

1 tion bears to the total General Fund reappropriation authority granted to all
2 state agencies.
3 SECTION 11. An emergency existing therefor, which emergency is hereby
4 declared to exist, this act shall be in full force and effect on and after
5 July 1, 2003.

This is a lump sum appropriation. Intent language is included to limit the amount of money that may be spent for system-wide needs to $75,000, limit the amount that may be used for Higher Education Research Center grants to not more than $1.6 million, limit the amount that may be used for technology incentive grants and related items to $1.75 million, limit the amount that may be used for activities associated with Idaho’s Comprehensive Literacy Act to $500,000, limit the amount that may be used for the Governor’s Excellence Initiative to $1.3 million, make certain code sections available with regard to this appropriation, require the tracking and reporting of faculty and staff turnover statistics at the higher education institutions, and provide carryover authority from FY 2003 into FY 2004 for any unexpended and unencumbered moneys. An emergency clause enables this act to take effect on July 1, 2003.
