1 AN ACT
2 RELATING TO ACTS OR SECTIONS OF ACTS ENACTED BY THE FIRST REGULAR SESSION OF
3 THE FIFTY-SEVENTH IDAHO LEGISLATURE; PROVIDING CLARIFICATION FOR EFFECTIVE
4 DATES FOR CERTAIN ACTS OR SECTIONS OF ACTS ENACTED BY THE FIRST REGULAR
5 SESSION OF THE FIFTY-SEVENTH IDAHO LEGISLATURE; AND DECLARING AN EMER-
6 GENCY.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. If the First Regular Session of the Fifty-seventh Idaho Legis-
9 lature has not adjourned sine die on or before May 2, 2003, all acts or sec-
10 tions of acts enacted by the First Regular Session of the Fifty-seventh Idaho
11 Legislature and signed into law or allowed to become law by the Governor with-
12 out his signature in which the entire act or sections of those acts would have
13 been effective on July 1, 2003, had the Legislature adjourned sine die on or
14 before May 2, 2003, shall be amended to have the act or the section of the act
15 become effective on July 1, 2003, and an emergency is declared to exist and
16 shall be deemed incorporated in the title of the bill and the preamble or the
17 body of the law, as applicable. The provisions of this section shall not
18 affect any act or section of an act signed into law or allowed to become law
19 by the Governor without his signature, in which any effective date other than
20 July 1, 2003, has been incorporated in the title of the bill and the preamble
21 or the body of the law, as applicable.
22 SECTION 2. An emergency existing therefor, which emergency is hereby
23 declared to exist, this act shall be in full force and effect on and after its
24 passage and approval.
STATEMENT OF PURPOSE
RS 13319
Article III of the Idaho Constitution requires:
SECTION 22. WHEN ACTS TAKE EFFECT. No act shall take effect
until sixty days from the end of the session at which the same
shall have been passed, except in case of emergency, which
emergency shall be declared in the preamble or in the body of
the law.
To avoid any possibility of delaying the effective dates of
legislation passed this year, this bill would clarify the effective
dates of all bills passed during the 2003 legislative session that
otherwise would have been effective on July 1, 2003, so as to
comply with the requirements of Article III and retain the July 1,
2003 effective dates and to provide notice to all those affected.
FISCAL NOTE
By preventing the delay in the effective dates of all legislation
passed this year, this bill would avoid the incalculable costs that
could result from any delay.
