In addition to the appropriation made in Section 1, Chapter 17 216, Laws of 2003, there is hereby appropriated to the Department of Environ- 18 mental Quality the following amounts to be expended for the designated pro- 19 grams according to the designated expense classes from the listed funds for 20 the period July 1, 2003, through June 30, 2004: 21 FOR 22 FOR FOR TRUSTEE AND 23 PERSONNEL OPERATING BENEFIT 24 COSTS EXPENDITURES PAYMENTS TOTAL 25 I. Notwithstanding any other provision of law to the contrary, 31 the appropriation made in Section 1, Chapter 216, Laws of 2003, to the Depart- 32 ment of Environmental Quality, is hereby reduced by the following amounts from 33 the listed program according to the designated expense classes from the listed 34 fund for the period July 1, 2003, through June 30, 2004: 35 AIR QUALITY: 36 FOR: 37 Personnel Costs $182,200 38 Operating Expenditures 117,800 39 TOTAL $300,000 40 FROM: 41 Air Quality Permitting Fund $300,000 42 SECTION 3. In addition to the appropriation made in Section 1, Chapter 2 1 227, Laws of 2003, there is hereby appropriated $171,000 to the Department of 2 Lands for the Forest and Range Fire Protection Program from the General Fund 3 for the period July 1, 2003, through June 30, 2004. 4 SECTION 4. In addition to the appropriation made in Section 1, Chapter 5 180, Laws of 2003, there is hereby appropriated the sum of $250,000 from the 6 General Fund to the Park Operations Division in the Idaho Department of Parks 7 and Recreation for personnel costs for the period July 1, 2003, through June 8 30, 2004; and the appropriation from the Parks and Recreation Fund to the Park 9 Operations Division is hereby reduced $250,000 for personnel costs for the 10 period July 1, 2003, through June 30, 2004. 11 SECTION 5. All moneys previously appropriated to the Idaho Department of 12 Parks and Recreation for the Bruneau Dunes Science Center challenge grant pro- 13 gram are hereby reappropriated to the Idaho Department of Parks and Recreation 14 for the period July 1, 2003, through June 30, 2004. 15 SECTION 6. There is hereby appropriated, and the State Controller is 16 hereby directed to transfer at the request of the Secretary of State, $167,000 17 from the General Fund to the Democracy Fund. 18 SECTION 7. In addition to the appropriation made in Section 1, Chapter 19 194, Laws of 2003, there is hereby reappropriated to the State Controller, the 20 unexpended and unencumbered cash balance of the data processing services fund 21 appropriation made to the State Controller for fiscal year 2003, to be used 22 for nonrecurring expenditures only for the period July 1, 2003, through June 23 30, 2004. 24 SECTION 8. In addition to the appropriation made in Section 1, Chapter 25 275, Laws of 2003, there is hereby appropriated to the Board of Tax Appeals in 26 the Department of Revenue and Taxation the following amounts, to be expended 27 according to the designated expense classes from the listed fund for the 28 period July 1, 2003, through June 30, 2004: 29 FOR: 30 Personnel Costs $13,200 31 Operating Expenditures 7,100 32 TOTAL $20,300 33 FROM: 34 General Fund $20,300 35 SECTION 9. In addition to the full-time equivalent positions authorized 36 in Section 2, Chapter 275, Laws of 2003, the Board of Tax Appeals is hereby 37 authorized a two-tenths (0.2) full-time equivalent position. 38 SECTION 10. In addition to the appropriation made in Section 2, Chapter 39 191, Laws of 2003, there is hereby appropriated the sum of $625,000 from the 40 General Fund to the Special Litigation Program in the Office of the Attorney 41 General for the period July 1, 2003, through June 30, 2004. 42 SECTION 11. The appropriation made in Section 1, Chapter 229, Laws of 43 2002, for the Special Litigation Program within the Office of the Attorney 44 General shall be for the period July 1, 2002, through June 30, 2004. 45 SECTION 12. In addition to the appropriation made in Section 1, Chapter 46 227, Laws of 2003, there is hereby appropriated $125,000 to the Department of 3 1 Lands for the Support Services Program for operating expenditures from the 2 General Fund for the period July 1, 2003, through June 30, 2004. Such moneys 3 shall be used to support the implementation of pilot projects recommended by 4 the federal lands working group regarding the management of federal lands in 5 Idaho. 6 SECTION 13. An emergency existing therefor, which emergency is hereby 7 declared to exist, this act shall be in full force and effect on and after 8 July 1, 2003.

This is a trailer appropriation bill for fiscal year 2004 to fill in some holes left by the original budgets set by the Joint Finance-Appropriations Committee. This bill would carve out a small portion of the additional revenues passed by the Legislature to cover some key items in these budgets.

The bill appropriates $1,811,700 from the General Fund and reduces dedicated funds by $550,000 for a total of $1,261,700.
Sections 1 and 2 deal with the Department of Environmental Quality. These sections shift $300,000 from the air quality permitting fund to the General Fund to assure the continuation of air quality monitoring and restore $153,400 to the Water Quality Program.
Section 3 provides $171,000 for the Forest and Range Fire protection Program in the Department of Lands to restore some of money cut for fire personnel and grants to local communities.
Section 4 restores $250,000 of a $639,000 cut in General Funds that the Department of Parks and Recreation took the first time around in JFAC. General Funds are increased $250,000 and dedicated park funds are reduced by the same amount.
Section 5 provides one more year of carryover authority for Parks and Recreation for a challenge grant program for the Bruneau Dunes Science Center. $400,000 in one-time General Funds was appropriated two years ago for this project, but the funds can only be spent if a like amount of donations or non-state funds can be secured as match.
Section 6 provides $167,000 in one-time General Funds to the office of the Secretary of State to provide matching fund support for the federal Help America Vote Act.
Section 7 provides the State Controller with carryover authority for its dedicated funds.
Sections 8 and 9 restore a two-tenths position reduction for the Board of Tax Appeals, and restore lost operating funds.
Section 10 provides $625,000 to the Attorney General for the Special Litigation program to augment the $326,600 that was appropriated during the first go around of budget-setting.
Section 11 provides the Office of the Attorney General carryover authority for the Special Litigation Program.
Section 12 provides $125,000 in one-time General Fund support to continue the federal lands working group.
