|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 13 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND DIRECTING THE IDAHO COUNCIL ON DEVEL- 3 OPMENTAL DISABILITIES, IN COLLABORATION WITH THE DEPARTMENT OF HEALTH AND 4 WELFARE AND OTHER STAKEHOLDERS, TO CONVENE A TASK FORCE TO DEVELOP A 5 WAIVER FOR A SELF-DIRECTED SERVICE DELIVERY SYSTEM FOR IDAHOANS WITH 6 DEVELOPMENTAL DISABILITIES AND REQUIRING A REPORT. 7 Be It Resolved by the Legislature of the State of Idaho: 8 WHEREAS, Medicaid costs for services to people with developmental disabil- 9 ities are increasing; and 10 WHEREAS, many Idahoans with developmental disabilities rely on Medicaid 11 for their long-term service needs; and 12 WHEREAS, growth in the Medicaid budget requires all opportunities for sav- 13 ings to be explored, including strategies for people with developmental dis- 14 abilities to become less dependent on the current service delivery system; and 15 WHEREAS, people with developmental disabilities should have authority over 16 their life decisions and be responsible for their choices; and 17 WHEREAS, people with developmental disabilities should control a limited 18 amount of dollars that can be used flexibly to acquire necessary supports; and 19 WHEREAS, although the state of Idaho has made some progress in designing a 20 service delivery system for people with developmental disabilities that per- 21 mits some choices, these choices are limited; and 22 WHEREAS, other states have developed and implemented self-determination 23 models which have increased cost effectiveness and consumer control; and 24 WHEREAS, all individuals belong in and bring value to their communities; 25 and 26 WHEREAS, all individuals with developmental disabilities are valued part- 27 ners in policymaking pertaining to their services and supports. 28 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 29 of the Fifty-seventh Idaho Legislature, the House of Representatives and the 30 Senate concurring therein, that the Legislature directs the Idaho Council on 31 Developmental Disabilities, in collaboration with the Department of Health and 32 Welfare and other stakeholders, to convene a task force for the purpose of 33 developing a Medicaid self-determination waiver. 34 BE IT FURTHER RESOLVED that the development of this waiver would include 35 participation of people with developmental disabilities, family members, 36 appropriate public agencies, service providers and advocates. 37 BE IT FURTHER RESOLVED that the Department of Health and Welfare will sub- 38 mit such a waiver to the federal Centers on Medicaid and Medicare for 39 approval. 40 BE IT FURTHER RESOLVED that this waiver will be available to no more than 41 two hundred qualified individuals with developmental disabilities, will cost 42 no more on average than services currently available through the HCBS waiver 43 for people with developmental disabilities, will include an individual budget 44 driven by a person-centered plan, will allow people with developmental dis- 2 1 abilities to negotiate for services and supports from non-Medicaid providers 2 with the assistance of a broker and a fiscal agent, and will continue for a 3 period of at least two years to permit adequate usage and collection. 4 AND BE IT FURTHER RESOLVED that progress on this effort shall be reported 5 to the Legislature by January 15, 2004.

STATEMENT OF PURPOSE RS 12799 The purpose of this legislation is to convene a group of individuals to develop a waiver to the Idaho's Medicaid program that would permit up to 200 qualified individuals with developmental disabilities, who choose to do so, the option of receiving services using a self-directed model. This model is in use in other states and the concept is promoted by the Centers on Medicaid and Medicare, the federal agency governing Medicaid programs. Once developed, the Department of Health and Welfare would have responsibility for submitting the waiver to CMS for approval. Once approved the waiver would be demonstrated for a period of at least two years, allowing participants adequate opportunity to determine its usefulness and allowing the state the time needed to analyze its cost effectiveness. FISCAL IMPACT Costs for the task force to develop the model waiver would be borne by individual members. Administrative support (including costs to assure the participation of consumers) would be provided by the Council on Developmental Disabilities. Technical assistance would be provided by participants. Once approved, there will be some training costs associated with implementation. Services provided during the course of the demonstration would cost no more than services for which the individuals would traditionally be eligible, and may, in fact, be less.
