|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 18 BY RESOURCES AND CONSERVATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF PARKS AND RECREATION RELATING TO THE ADMINISTRATION OF PARK AND 4 RECREATION AREAS AND FACILITIES. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Legislature is vested with authority to reject executive 7 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 8 that the Legislature finds that the rules are not consistent with legislative 9 intent; and 10 WHEREAS, it is the finding of the Legislature that certain rules of the 11 Department of Parks and Recreation relating to the administration of park and 12 recreation areas and facilities are not consistent with legislative intent and 13 should be rejected. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 15 of the Fifty-seventh Idaho Legislature, the House of Representatives and the 16 Senate concurring therein, that IDAPA 26.01.20, Section 010, subsection 04, a 17 rule of the Department of Parks and Recreation relating to the definition of a 18 camping unit, and IDAPA 26.01.20, Section 200, subsection 01, a rule of the 19 Department of Parks and Recreation relating to camping occupancy, adopted as 20 pending rules under Docket Number 26-0120-0202, be, and the same are hereby 21 rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS 12892 This concurrent resolution would reject a pending rule change of the Department of Parks and Recreation relating to the administration of park and recreation areas and facilities, and concerning camping units and camping occupancy. The effect of this resolution, if adopted by both houses, would be to prevent the agency rule from going into effect.
