|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 22 BY ENVIRONMENTAL AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF ENVIRONMENTAL QUALITY RELATING TO UNDERGROUND STORAGE TANKS AND 4 LEAKING PETROLEUM STORAGE TANKS, AND WATER QUALITY STANDARDS AND WASTEWA- 5 TER TREATMENT REQUIREMENTS. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, the Legislature is vested with authority to reject executive 8 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 9 that the Legislature finds that the rules are not consistent with legislative 10 intent; and 11 WHEREAS, it is the finding of the Legislature that certain rules of the 12 Department of Environmental Quality relating to underground storage tanks and 13 leaking petroleum storage tanks, and water quality standards and wastewater 14 treatment requirements are not consistent with legislative intent and should 15 be rejected. 16 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 17 of the Fifty-seventh Idaho Legislature, the House of Representatives and the 18 Senate concurring therein, that IDAPA 58.01.07, pending rules of the Depart- 19 ment of Environmental Quality relating to underground storage tanks and leak- 20 ing petroleum storage tanks, adopted as pending rules under Docket Number 21 58-0107-0201, the entire pending rules docket, and IDAPA 58.01.02, pending 22 rules of the Department of Environmental Quality relating to water quality 23 standards and wastewater treatment requirements, adopted as pending rules 24 under Docket Number 58-0102-0202, the entire pending rules docket, be, and the 25 same are hereby rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS 12981 This concurrent resolution would reject pending rules of the Department of Environmental Quality relating to underground storage tanks and leaking petroleum storage tanks, and water quality standards and wastewater treatment requirements. The effect of this resolution, if adopted by both houses, would be to prevent the agency rules from going into effect.
