|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 29 BY WAYS AND MEANS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND ENCOURAGING THE IDAHO COUNCIL ON 3 DEVELOPMENTAL DISABILITIES, IN COLLABORATION WITH THE DEPARTMENT OF HEALTH 4 AND WELFARE AND OTHER STAKEHOLDERS, IN CONVENING A TASK FORCE TO DEVELOP A 5 WAIVER FOR A SELF-DIRECTED SERVICE DELIVERY SYSTEM FOR IDAHOANS WITH 6 DEVELOPMENTAL DISABILITIES AND REQUESTING A REPORT. 7 Be It Resolved by the Legislature of the State of Idaho: 8 WHEREAS, Medicaid costs for services to people with developmental disabil- 9 ities are increasing; and 10 WHEREAS, many Idahoans with developmental disabilities rely on Medicaid 11 for their long-term service needs; and 12 WHEREAS, growth in the Medicaid budget requires all opportunities for sav- 13 ings to be explored, including strategies for people with developmental dis- 14 abilities to become less dependent on the current service delivery system; and 15 WHEREAS, people with developmental disabilities should have authority over 16 their life decisions and be responsible for their choices; and 17 WHEREAS, people with developmental disabilities should control a limited 18 amount of dollars that can be used flexibly to acquire necessary supports; and 19 WHEREAS, although the state of Idaho has made some progress in designing a 20 service delivery system for people with developmental disabilities that per- 21 mits some choices, these choices are limited; and 22 WHEREAS, other states have developed and implemented self-determination 23 models which have increased cost effectiveness and consumer control; and 24 WHEREAS, all individuals belong in and bring value to their communities; 25 and 26 WHEREAS, all individuals with developmental disabilities are valued part- 27 ners in policymaking pertaining to their services and supports. 28 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 29 of the Fifty-seventh Idaho Legislature, the House of Representatives and the 30 Senate concurring therein, that the Legislature encourages the Idaho Council 31 on Developmental Disabilities to collaborate with the Department of Health and 32 Welfare and other stakeholders, in convening a task force for the purpose of 33 developing a Medicaid self-determination waiver. 34 BE IT FURTHER RESOLVED that the Legislature supports including participa- 35 tion of people with developmental disabilities, family members, appropriate 36 public agencies, service providers and advocates in the development of this 37 waiver. 38 BE IT FURTHER RESOLVED that the Legislature encourages the Department of 39 Health and Welfare to submit such a waiver to the federal Centers on Medicaid 40 and Medicare for approval, following an opportunity for legislative review 41 during the 2004 legislative session. 42 BE IT FURTHER RESOLVED that the Legislature recommends that this waiver 43 would be available to no more than two hundred qualified individuals with 44 developmental disabilities, would cost no more on average than services cur- 2 1 rently available through the HCBS waiver for people with developmental dis- 2 abilities, would include an individual budget driven by a person-centered 3 plan, would allow people with developmental disabilities to negotiate for ser- 4 vices and supports from traditional and nontraditional providers with the 5 assistance of a broker and a fiscal agent, and would continue for a period of 6 at least two years to permit adequate usage and data collection. 7 AND BE IT FURTHER RESOLVED that the Legislature requests that the Idaho 8 Council on Developmental Disabilities report its progress on this effort, 9 including cost analysis, to the Legislature by January 15, 2004.
STATEMENT OF PURPOSE RS 13237 This resolution encourages the Council on Developmental Disabilities to convene a Task Force to develop a Medicaid model waiver that would permit up to 200 adults with developmental disabilities to choose a different way of receiving services. The services would be based on need as determined by a consumer- centered plan and would cost no more, on average, than the present costs for these 200 people. Implementation of this model will require the Department of Health and Welfare to submit a waiver application to the federal Centers on Medicaid and Medicare. FISCAL IMPACT This waiver will be developed by a group of individuals convened by the Council on Developmental Disabilities. The meeting and technical assistance costs to support this group will be paid by the Council with allocated federal funds. There will be no fiscal impact to the state in FY 2004.
