|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1005 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE CONTRACT TO PRINT IDAHO SUPREME COURT REPORTS; AMENDING SEC- 3 TION 1-506, IDAHO CODE, TO PROVIDE FOR A MAXIMUM NUMBER OF COPIES OF EACH 4 VOLUME THAT ARE TO BE FURNISHED TO THE STATE BY THE PRINTER, TO PROVIDE 5 THAT THE EXACT NUMBER OF COPIES TO BE FURNISHED SHALL BE DETERMINED BY THE 6 IDAHO SUPREME COURT AND TO MAKE TECHNICAL CORRECTIONS; AND REPEALING SEC- 7 TION 1-507, IDAHO CODE, REQUIRING THE PRINTER TO POST BOND. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 1-506, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 1-506. CONTRACT TO PRINT REPORTS. The contract to print the reports of 12 such decisions shall be let by the reporter with the approval of theJjustices 13 of theSsupremeCcourt, or a majority thereof, to some person or persons who 14 will print the same on terms most advantageous to the state, and who will fur- 15 nish the state with a maximum of four hundred (400) copies of each volume, the 16 exact number of copies to be determined by the supreme court, at a cost to be 17 fixed in such contract per volume and who will agree to furnish copies of the 18 reports to the public at a price not exceeding the cost per volume at which 19 the same is to be furnished to the state: provided, the work shall be done in 20 the state of Idaho, if responsible parties therein offer to do said work on 21 terms as favorable to the state as any outside bidder. 22 SECTION 2. That Section 1-507, Idaho Code, be, and the same is hereby 23 repealed.
STATEMENT OF PURPOSE RS 12514 This bill is one of a series of bills that the Supreme Court has recommended in its annual report to the Governor concerning defects or omissions in the laws, as required under article V, section 25 of the Idaho Constitution. This bill amends Section 1-506 and repeals Section 1-507, Idaho Code, relating to the printing of the Idaho Supreme Court reports, to remove outdated language requiring the printer to furnish 400 copies of each volume of the Idaho Reports and to eliminate the requirement that the printer furnish a five hundred dollar ($500) performance bond in respect to the printing contract. The Idaho Supreme Court reports contain a compilation of Supreme Court and Court of Appeals decisions. Based upon current demands, only 260 copies of the Idaho Reports are needed and the present 400-copy requirement in the statute is therefore excessive. The proposed amendment will allow the printer to furnish a smaller number of volumes as determined by the Supreme Court. Section 1-507, Idaho Code, which requires the printer to submit a $500 bond for each numbered volume, is repealed because the $500 amount established in 1903 is no longer realistic, practical, or necessary to compel performance under the printing contract.
