  1                                        AN ACT
  2    RELATING TO INDEPENDENT EXPENDITURES; AMENDING SECTION 67-6611, IDAHO CODE, TO
  3        PROVIDE CERTAIN REPORTING REQUIREMENTS FOR PERSONS MAKING DESIGNATED INDE-
  4        PENDENT EXPENDITURES.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 67-6611, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        67-6611.  INDEPENDENT  EXPENDITURES. (1) Each person who makes independent
  9    expenditures in an aggregate amount exceeding one hundred  dollars  ($100)  in
 10    support  of  or in opposition to any one (1) candidate, political committee or
 11    measure, shall file a statement of  the  expenditure  with  the  secretary  of
 12    state.
 13        (2)  Statements  shall be filed with the secretary of state, not less than
 14    seven (7) days prior to the primary and general election and thirty (30)  days
 15    after the primary and general election.
 16        (3)  The  statement  shall contain the following information: (a) the name
 17    and address of any person to whom an expenditure in excess  of  fifty  dollars
 18    ($50.00)  has  been  made by any such person in support of or in opposition to
 19    any such candidate or issue during the reporting  period,  together  with  the
 20    amount,  date  and  purpose of each such expenditure; and (b) the total sum of
 21    all expenditures made in support of or in opposition to any such candidate  or
 22    measure.
 23        (4)  In  addition to the requirements set forth in subsections (1) and (2)
 24    of this section, each person who makes independent expenditures in  an  aggre-
 25    gate  amount  of one thousand dollars ($1,000) or more after the sixteenth day
 26    before, but more than forty-eight (48) hours before, any  primary  or  general
 27    election, shall file a written statement of the expenditure with the secretary
 28    of  state  not less than forty-eight (48) hours from the time of such expendi-
 29    ture. The statement shall include the information required in  subsection  (3)
 30    of this section.

The objective of this legislation is to provide a reporting
requirement of independent expenditures by non-candidates. This
legislation represents the work of the Task Force to Study Campaign
Financing for Judicial Elections.




                         FISCAL IMPACT
                                
No projected fiscal impact other than the filing of other than the
administrative costs associated with filing of reports. Such costs are
currently not liquidated.
