|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1010 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO MOTOR VEHICLE FINANCIAL RESPONSIBILITY; AMENDING SECTION 49-1210, 3 IDAHO CODE, TO PROVIDE A CODE REFERENCE, TO CLARIFY PERSONS REQUIRED TO 4 SHOW PROOF OF RESPONSIBILITY, AND TO REMOVE PROVISIONS WHICH REQUIRE THE 5 TRANSPORTATION DEPARTMENT TO VERIFY REGISTRATION OF A VEHICLE BY A PERSON 6 REQUIRED TO SHOW PROOF OF FINANCIAL RESPONSIBILITY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-1210, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-1210. CERTIFICATE OF INSURANCE AS PROOF. (1) Proof of financial 11 responsibility, as required by the provisions of section 49-1208, Idaho Code, 12 shall be furnished for each motor vehicle registered by any person required to 13 provide such proof,by filingor shall be furnished by any person required to 14 provide such proof even if the person is not the owner of a motor vehicle. 15 Such persons shall file with the department the written certificate of any 16 insurance carrier duly authorized to do business in this state on a form 17 approved by the department certifying that there is in effect a motor vehicle 18 liability policy for the benefit of the person required to furnish proof of 19 financial responsibility. The certificate shall give the effective date of the 20 motor vehicle liability policy, which date shall be the same as the effective 21 date of the certificate., andThe certificate shall also designateby explicit22description orby appropriate reference all motor vehicles covered by that 23 policy, unless the policy is issued to a person who is not the owner of a 24 motor vehicle. 25(2) No motor vehicle shall be or continue to be registered in the name of26any person required to file proof of financial responsibility unless the motor27vehicle is so designated in such a certificate.

STATEMENT OF PURPOSE RS 12394 This legislation removes language in Section 49-1210, Idaho Code, that requires the Idaho Transportation Department to cross- reference proof-of-financial-responsibility (SR-22) records with vehicle registration records, and clarifies that individuals that do not own motor vehicles must still comply with proof of financial responsibility requirements preliminary to reinstatement of driving privileges after suspension of those privileges for certain convictions. The department currently has no means to administer a comprehensive vehicle/driver tracking and cross-referencing program. If this legislation is enacted, the department will continue to record proof of financial responsibility information on driver records, but will not be required to prohibit registration of a vehicle or cancel a vehicle registration based on the "proof-of-financial- responsibility" filing requirements of one of the owners listed on a vehicle registration. If this legislation is not enacted, the department may be required to develop a system to cross-reference proof of financial responsibility and driver records with vehicle registration records and begin collection of driver license numbers for each individual listed on every vehicle registration. FISCAL IMPACT This legislation has no fiscal impact. The department's intent is to continue to administering Section 49-1210, Idaho Code, by linking the SR-22 requirement to the driver rather than also developing an all-encompassing system to cross-reference and track drivers listed on vehicle registrations. If Section 49-1210, Idaho Code, is not amended as proposed, considerable software programming and human resources will be required to fully implement the existing statute.
