1 AN ACT
2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF AGRICULTURE FOR FISCAL
3 YEAR 2003; PROVIDING TRANSFERS TO THE PEST CONTROL DEFICIENCY FUND; AND
4 DECLARING AN EMERGENCY.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. In addition to the appropriation made in Section 1, Chapter
7 270, Laws of 2002, there is hereby appropriated to the Department of Agricul-
8 ture the following amounts to be expended for the designated program according
9 to the designated expense classes from the listed fund for the period July 1,
10 2002, through June 30, 2003:

17 Pest Control Deficiency Fund $129,500
18 SECTION 2. Notwithstanding Section 22-3415, Idaho Code, the State Con-
19 troller shall make cash transfers from the Agricultural Fees - Pesticides Fund
20 to the Pest Control Deficiency Fund, at the request of the Director of the
21 Department of Agriculture, not to exceed $129,500, for the period July 1,
22 2002, through June 30, 2003.
23 SECTION 3. An emergency existing therefor, which emergency is hereby
24 declared to exist, this act shall be in full force and effect on and after its
25 passage and approval.

This supplemental appropriation to the Department of Agriculture provides $104,500 for Mormon cricket baiting, $9,900 for gypsy moth survey, and $15,100 for exotic pest survey for a total of $129,500. The appropriation includes $27,100 for personnel costs and $102,400 for operating expenditures to retire deficiency warrants authorized by the Board of Examiners for agricultural pest control.

Although the annual deficiency warrants for agricultural pest control are traditionally paid from the General Fund, this appropriation reimburses the deficiency warrant fund from the Pesticide Fund on a one-time basis. Every pesticide which is sold in the state of Idaho must be registered with the Department of Agriculture. The registrant pays an annual fee as prescribed by rule. The fund balance at the end of FY 2002 for that fund was $1,178,900. This appropriation covers costs incurred between November 2001 and June 30, 2002. Future deficiency warrants will be on a fiscal year basis.
