|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1036 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO GROOMED SNOWMOBILE TRAILS; AMENDING SECTION 67-7112, IDAHO CODE, 3 TO EXCLUDE CERTAIN ALL TERRAIN VEHICLES FROM SNOWMOBILE REGISTRATION 4 REQUIREMENTS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 67-7112, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 67-7112. GROOMED SNOWMOBILE TRAILS. Any all terrain vehicle operating on 9 groomed snowmobile trails during the winter snowmobiling season when the 10 trails are groomed shall be registered as a snowmobile under the provisions of 11 section 67-7103, Idaho Code. Provided however, any all terrain vehicle 12 required to be registered under any other provision of Idaho law, and in com- 13 pliance with those registration requirements, shall not be subject to the 14 snowmobile registration requirements of this section. Counties shall have the 15 option to allow all terrain vehicles, if registered, to use snowmobile trails 16 in the county.
STATEMENT OF PURPOSE RS 12584 The purpose of this legislation is to require that All Terrain Vehicles (ATVs) not be registered in the State as snowmobiles. The current law is unfair to owners of all terrain vehicles because it requires that any ATV operating on a groomed snowmobile trail must be registered as a snowmobile in addition to the Off Highway Vehicle registration. Therefore, an amendment is proposed to Idaho Code 67-1112, which will add to it the following sentence, "Provided, however, any All Terrain Vehicle required to be registered under any other provision of Idaho law, and in compliance with those registration requirements, shall not be subject to the snowmobile registration requirements of this section." FISCAL IMPACT All Terrain Vehicles are currently double-registered. This would require only one registration, plus grooming fee, as applicable under current law. Contact Name: Senator Kent M.
