MOTOR VEHICLES - Amends existing law to provide that no person shall drive any
motor vehicle with any sign, poster or nontransparent material upon the front
windshield, the front side vents or front side windows to the immediate right
and left of the driver which obstructs the driver's clear view of the highway

  1                                        AN ACT
  2    RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-943, IDAHO  CODE,  TO  PROVIDE
  3        THAT  NO  PERSON  SHALL  DRIVE  ANY MOTOR VEHICLE WITH ANY SIGN, POSTER OR
  4        NONTRANSPARENT MATERIAL UPON THE FRONT WINDSHIELD, THE FRONT SIDE VENTS OR
  5        FRONT SIDE WINDOWS TO THE IMMEDIATE RIGHT AND LEFT  OF  THE  DRIVER  WHICH
  6        OBSTRUCTS THE DRIVER'S CLEAR VIEW OF THE HIGHWAY OR ANY INTERSECTING HIGH-
  7        WAY; AND DECLARING AN EMERGENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section  49-943, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        49-943.  WINDSHIELDS TO BE UNOBSTRUCTED AND EQUIPPED WITH WIPERS.  (1)  No
 12    person  shall  drive  any  motor  vehicle  with  any  sign,  poster,  or other
 13    nontransparent material upon the front windshield, side wings, or side or rear
 14    windows of the vehicle the front side vents, or  front  side  windows  to  the
 15    immediate right and left of the driver which obstructs the driver's clear view
 16    of the highway or any intersecting highway.
 17        (2)  The windshield on every motor vehicle shall be equipped with a device
 18    for  cleaning  rain, snow, or other moisture from the windshield, which device
 19    shall be constructed as to be controlled or operated  by  the  driver  of  the
 20    vehicle.
 21        (3)  Every  windshield  wiper  upon a motor vehicle shall be maintained in
 22    good working order.
                                                                        
 23        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 24    declared to exist, this act shall be in full force and effect on and after its
 25    passage and approval.

                      STATEMENT OF PURPOSE

This legislation updates the statute, Section 49-943, Idaho Code, to a
more modern description of vehicle windows as well as utilizes language
from other statutes. Its main purpose is to allow vehicles to display
signage in rear and rear side windows. It makes the visual requirement
the same for a four door vehicle as a two door pickup with a camper.
