1 AN ACT
2 RELATING TO BEER AND WINE AND RESTRICTIONS CONCERNING AGE; AMENDING SECTION
3 23-943, IDAHO CODE, TO PROVIDE THAT IT IS LAWFUL FOR PERSONS EIGHTEEN
4 YEARS OF AGE OR OLDER TO SELL, SERVE, POSSESS OR DISPENSE BEER OR WINE IN
5 THE COURSE OF THEIR EMPLOYMENT AND TO MAKE TECHNICAL CORRECTIONS; AND
6 AMENDING SECTION 23-1013, IDAHO CODE, TO ALLOW ANY PERSON WHO IS EIGHTEEN
7 YEARS OF AGE OR OLDER TO SELL, SERVE, POSSESS OR DISPENSE BEER IN THE
8 COURSE OF HIS EMPLOYMENT.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 23-943, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 23-943. PERSONS UNDER SPECIFIED AGES FORBIDDEN TO ENTER, REMAIN IN OR
13 LOITER AT CERTAIN LICENSED PLACES. (1) No person under the age of twenty-one
14 (21) years shall enter, remain in or loiter in or about any place, as herein
15 defined, licensed for the sale of liquor by the drink at retail, or sale of
16 beer for consumption on the premises; nor shall any licensee of either such
17 place, or any person in charge thereof, or on duty while employed by the
18 licensee therein, permit or allow any person under the age specified with
19 respect thereto to remain in or loiter in or about such place.
20 (2) Provided, however, it is lawful for persons who are musicians and
21 singers eighteen (18) years of age or older, to enter and to remain in any
22 place as defined in section 23-942, Idaho Code, but only during and in the
23 course of their employment as musicians and singers.
24 (3) Provided further, that it is lawful for persons who are:
25 (a) Nnineteen (19) years of age or older to sell, serve, possess or dis-
26 pense liquor, and
27 (b) Eighteen (18) years of age or older to sell, serve, possess or dis-
28 pense beer or wine,
29 in the course of their employment in any place as defined in section 23-942,
30 Idaho Code, or in any other place where liquor, beer or wine are is lawfully
31 present, so long as such place is the place of employment for such person
32 under twenty-one (21) years of age. However, the foregoing shall not permit
33 the sale or distribution of any alcoholic beverages to any person under the
34 ages specified for sale of alcoholic beverages.
35 SECTION 2. That Section 23-1013, Idaho Code, be, and the same is hereby
36 amended to read as follows:
37 23-1013. RESTRICTIONS CONCERNING AGE. Any person who is nineteen eighteen
38 (198) years of age or older may sell, serve, possess or dispense beer in the
39 course of his employment, otherwise it shall be unlawful for any person to
40 sell, serve or dispense beer to or by any person under twenty-one (21) years
41 of age, proof of which, shall be a validly issued state, district, territo-

1 rial, possession, provincial, national or other equivalent government driver's
2 license, identification card or military identification card bearing a photo-
3 graph and date of birth, or a valid passport.
STATEMENT OF PURPOSE
RS 12719
The objective of this legislation is to change the age by which the
employees of retailers may sell beer and wine from the age of nineteen
to eighteen. This legislation will allow any person who is eighteen
years of age or older to sell beer or wine in the course of his
employment.
