1 AN ACT
2 RELATING TO DISSOLUTION OF HIGHWAY DISTRICTS; AMENDING SECTION 40-1802, IDAHO
3 CODE, TO REVISE THE MINIMUM SIGNATURE REQUIREMENTS FOR A PETITION OF DIS-
4 SOLUTION OF A HIGHWAY DISTRICT; AND DECLARING AN EMERGENCY.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 40-1802, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 40-1802. PETITION FOR DISSOLUTION -- CONTENTS. All proceedings for the
9 dissolution of highway districts shall be initiated by a petition of the
10 greater of: twenty-five (25) qualified electors of the district or twenty-five
11 percent (250%) or more of the qualified electors of the district who voted at
12 the last election held for the election of highway district commissioner(s),
13 addressed to the commissioners of the county in which the district is situate,
14 and which shall concisely state the grounds or reasons for the dissolution and
15 contain a request for a hearing of the petition.
16 SECTION 2. An emergency existing therefor, which emergency is hereby
17 declared to exist, this act shall be in full force and effect on and after its
18 passage and approval.

This legislation changes the number of electors required to
dissolve a highway district from twenty-five (25) persons to the
greater of twenty-five (25) qualified electors of the district ortwenty percent(20%) of those qualified electors who voted in the
last election held for highway district commissioners.
This legislation is necessary to avoid allowing just a relative
few individuals from causing significant disruption and costs to
larger highway districts.

This law will have no direct fiscal effect on state or local
governments.
