  1                                        AN ACT
  2    RELATING TO PUBLIC SCHOOL SUPPORT; AMENDING CHAPTER 10, TITLE 33, IDAHO  CODE,
  3        BY  THE ADDITION OF A NEW SECTION 33-1018, IDAHO CODE, TO REQUIRE AN ADDI-
  4        TIONAL DISTRIBUTION TO SCHOOL DISTRICTS WHEN THE ACTUAL  NUMBER  OF  STATE
  5        SUPPORT  UNITS  IS  GREATER THAN THE ESTIMATED NUMBER STATED IN THE PUBLIC
  6        SCHOOL APPROPRIATION.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Chapter 10, Title 33, Idaho Code, be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 33-1018, Idaho Code, and to read as follows:
                                                                        
 11        33-1018.  PUBLIC SCHOOL SUPPORT UNIT VARIABILITY.  The  legislature  shall
 12    annually  state  in  the appropriation for the educational support program the
 13    estimate of the number of total state support units upon which the  appropria-
 14    tion  is  based, and the net state funding per support unit. The department of
 15    education shall, before the end of each fiscal year, calculate the actual num-
 16    ber of total state support units upon which the final distribution  to  public
 17    schools will be made.
 18        If  the  actual  number  of  total state support units is greater than the
 19    estimated number of total state support units stated in the appropriation  for
 20    the  educational  support  program, then the difference in total state support
 21    units shall be distributed to the districts through a transfer  by  the  state
 22    controller to the public school income fund.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 12729
          This legislation is being introduced for the purpose of
protecting school districts from a shortfall of state
appropriated dollars per support unit.  If the number of
estimated support units is less than the actual number of support
units generated in any given year, the appropriated support unit
value will be less than the amount upon which the school district
budget is based.  By a transfer of money from the budget
stabilization fund established in IC 57-814 to the public school
income fund, the appropriated support unit value will remain
whole and the school district will be able to maintain its budget
for that fiscal year.
                          FISCAL IMPACT
There will be no fiscal impact for years in which the estimated
support units are covered by the appropriations to the public
schools.  The impact for years in which the number of actual
support units is greater than the estimated number of support
units will be proportional to that difference.
