  1                                        AN ACT
  2    RELATING TO MARRIAGE; AMENDING SECTION 32-209, IDAHO CODE, TO CLARIFY THE PUB-
  3        LIC POLICY OF THE STATE OF IDAHO REGARDING RELATIONSHIPS INTENDED AS  SUB-
  4        STITUTES FOR MARRIAGE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  32-209, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        32-209.  RECOGNITION OF FOREIGN OR OUT-OF-STATE MARRIAGES.  All  marriages
  9    contracted  without  this state, which would be valid by the laws of the state
 10    or country in which the same were contracted, are valid in this state,  unless
 11    they  violate the public policy of this state. Marriages that violate the pub-
 12    lic policy of this state include, but are not limited to, same-sex  marriages,
 13    and marriages entered into under the laws of another state or country with the
 14    intent to evade the prohibitions of the marriage laws of this state. It is the
 15    public  policy of the state that relationships intended as substitutes for, or
 16    the equivalent of, marriage including, but not limited to, "civil  unions"  or
 17    "domestic  partnerships,"  shall not be recognized in this state. The recogni-
 18    tion or extension to nonmarital relationships of any or all of those benefits,
 19    rights, responsibilities, or obligations that exist as a  result  of  a  legal
 20    marriage is against the public policy of this state.

intended as substitutes for, or the equivalent of, marriage are against
the public policy of the state.
