2 RELATING TO THE PUBLIC UTILITIES COMMISSION; AMENDING CHAPTER 3, TITLE 61,
3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 61-307A, IDAHO CODE, TO PRO-
4 VIDE FOR A PUBLIC HEARING ON RATE INCREASES PRIOR TO THE COMMISSION
5 RECEIVING THE COMMISSION STAFF'S RECOMMENDATION; AND DECLARING AN EMER-
6 GENCY.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 3, Title 61, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 61-307A, Idaho Code, and to read as follows:
11 61-307A. STAFF RECOMMENDATION ON INCREASES -- PUBLIC HEARING PRIOR. When
12 the commission is determining whether to grant an increase in any rate, fare,
13 toll rental charge or classification or service of a public utility or to
14 approve a power cost adjustment increase reflected in a usage-based charge of
15 a public utility: a fuel or power cost adjustment; a purchased gas adjustment
16 tracker rate; a commodity electric or gas tracker rate adjustment; or a pur-
17 chased power tracker rate, the commission shall hold a public hearing on the
18 proposed increase in the service territory or area of the public utility prior
19 to when the commission receives the commission staff's recommendation on the
20 proposed increase. Notice of the public hearing shall be sent a minimum of one
21 (1) week prior to the public hearing to newspapers of general circulation in
22 the area of the proposed rate increase and to radio and television stations in
23 the area of the proposed rate increase and shall specify the subject matter of
24 the proposed increases. Additionally the commission shall post the notice on
25 its website, shall have caused the notice to be placed on the state of Idaho's
26 website and shall invite the public to comment and participate on the proposed
27 increase or power cost adjustment increase.
28 SECTION 2. An emergency existing therefor, which emergency is hereby
29 declared to exist, this act shall be in full force and effect on and after its
30 passage and approval.

The purpose of this legislation is to amend Chapter 3, Title 61 of the Idaho Code by adding a new
section 61-307A to provide for a public hearing on rate increases prior to the commission
receiving the commission staff s recommendation; and declaring an emergency.
