standing in other states or territories and who meet certain qualifications

  1                                        AN ACT
  2    RELATING TO THE IDAHO CERTIFIED  SHORTHAND  REPORTERS  ACT;  AMENDING  SECTION
  3        54-3108,  IDAHO  CODE,  TO  PROVIDE  THAT  PERSONS WHO ARE CERTIFIED COURT
  4        REPORTERS OR CERTIFIED SHORTHAND  REPORTERS  IN  GOOD  STANDING  IN  OTHER
  5        STATES OR TERRITORIES AND WHO MEET CERTAIN QUALIFICATIONS AS DETERMINED BY
  6        THE STATE CERTIFIED SHORTHAND REPORTERS BOARD SHALL BE ENTITLED TO REGULAR
  7        CERTIFICATION WITHOUT EXAMINATION UPON PAYMENT OF A FEE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section 54-3108, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        54-3108.  QUALIFICATIONS -- CERTIFICATION WITHOUT EXAMINATION  --  RENEWAL
 12    OF  CERTIFICATES.  (a)  Any applicant who is a citizen of the United States of
 13    good moral character, having graduated from an accredited high school or  hav-
 14    ing had an equivalent education, and having passed a reporters' examination as
 15    herein  provided  shall  be  entitled  to receive a certificate as a certified
 16    shorthand reporter upon payment of the fees required by this act. All applica-
 17    tions shall be in such form as prescribed by the  board  and  filed  with  the
 18    board  at least thirty (30) days prior to the announced date of the reporters'
 19    examination. The board in its discretion may make such  additional  investiga-
 20    tion  and inquiry, or require additional information from the applicant, as it
 21    shall deem necessary in determining the qualifications of the  applicant.  The
 22    board  shall  thereupon  notify the applicant as to whether his application to
 23    take the reporters' examination is accepted.
 24        (b)  Any applicant who was an official court reporter within the state  of
 25    Idaho  upon  the effective date of this act and any freelance reporter who has
 26    been in the active practice of shorthand reporting for at least one  (1)  year
 27    within the state of Idaho immediately preceding the effective date of this act
 28    shall  not be required to take or pass the reporters' examination but shall be
 29    entitled to a regular certified shorthand reporter certificate upon  filing  a
 30    proper application showing that he possesses the other required qualifications
 31    and upon paying the fees required by this chapter.
 32        (c)  A person who can show to the satisfaction of the board that he or she
 33    has  met  the  qualifications  set forth in subsection (a) of this section and
 34    who, at the time of application, is a certified court  reporter  or  certified
 35    shorthand  reporter in good standing under the laws of another state or terri-
 36    tory, and who can show to the satisfaction of the board that  he  or  she  has
 37    passed a certification examination, shall be entitled to regular certification
 38    without  examination upon payment to the board of the applicable fee set forth
 39    in section 54-3110, Idaho Code.
 40        (d)  All regular certified shorthand reporter certificates shall be issued
 41    for a period of one (1) year and  shall  be  renewable  upon  payment  of  the
 42    renewal  fee  prescribed  in  section  54-3110,  Idaho Code, for an additional
 43    period of one (1) year.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13018
The purpose of this proposed legislation is to provide
reciprocity for individuals in the shorthand or court reporting
profession.  If an individual is certified in any other state
they will be able to practice in the state of Idaho without
having to take the Idaho exam.
