3 STATE EMPLOYEES; AMENDING SECTION 67-5309C, IDAHO CODE, TO PROVIDE FOR
4 GRANTING OF BONUSES TO EMPLOYEES FOR SUGGESTIONS OR RECOMMENDATIONS WHICH
5 RESULTED IN COST SAVINGS OR GREATER EFFICIENCIES TO THE DEPARTMENT OR TO
6 THE STATE OF IDAHO.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 67-5309C, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 67-5309C. PAY GRADES AND MERIT INCREASES. (a) The following schedule
11 establishes the pay grades for all positions classified pursuant to chapter
12 53, title 67, Idaho Code.

29 (b) It is hereby declared to be the intent of the legislature that an
30 employee may expect to advance in the salary range to the labor market average
31 rate for the pay grade assigned to a classification. Advancement in pay shall
32 be based solely on performance, including factors such as productivity, reli-
33 ability, effectiveness, and the ability to achieve the goals and objectives of
34 the particular position. No employee shall advance in a salary range without
35 performance evaluation by the employee's immediate supervisor, approved by
36 the departmental director or the director's designee certifying that the
37 employee meets the performance criteria of the assigned position.
38 (i) When necessary to obtain or retain qualified personnel in a particu-
39 lar classification, upon petition of the appointing authority to the
40 administrator containing acceptable reasons therefor, a higher temporary
41 pay grade may be authorized by the administrator which, if granted, shall
42 be reviewed annually to determine the need for continuance.
43 (ii) Each employee's work performance shall be evaluated after one thou-

1 sand forty (1,040) hours of credited state service from the date of ini-
2 tial appointment or promotion and after each two thousand eighty (2,080)
3 hours of credited state service thereafter by his or her immediate super-
4 visor. Employees may be eligible for advancement in pay, if certified as
5 meeting the performance requirements of subsection (b) of this section;
6 however, such in-grade advancement shall not be construed as a vested
7 right. The department director shall designate, upon agreement with the
8 employee, whether such in-grade advancement is temporary, conditional or
9 permanent. It shall be the specific responsibility of the supervisor and
10 the departmental director to effect the evaluation prescribed in subsec-
11 tion (b) of this section on an evaluation form approved by the administra-
12 tor for that purpose.
13 (iii) In addition to pay increases authorized in paragraph (ii) of this
14 subsection, the department director may grant a classified employee hold-
15 ing permanent status a lump sum bonus not to exceed one thousand dollars
16 ($1,000) in any given fiscal year based upon excellent performance as
17 indicated by the performance evaluation as outlined in subsection (b) of
18 this section. Exceptions to the one thousand dollar ($1,000) limit pro-
19 vided in this section paragraph may be granted if approved in advance by
20 the state board of examiners.
21 (iv) In addition to pay increases authorized in paragraph (ii) of this
22 subsection, the department director may grant a classified employee hold-
23 ing permanent status a lump sum bonus not to exceed one thousand dollars
24 ($1,000) in any given fiscal year based upon suggestions or recommenda-
25 tions made by the employee which resulted in taxpayer savings as a result
26 of cost savings or greater efficiencies to the department or to the state

1 AMENDMENT TO THE BILL
2 On page 2, following line 29 insert:
3 "SECTION 2. That Section 59-1603, Idaho Code, be, and the same is hereby
4 amended to read as follows:
5 59-1603. CONFORMITY WITH CLASSIFIED POSITIONS. (1) To the extent possi-
6 ble, each nonclassified position in the executive department will be paid a
7 salary or wage comparable to classified positions with similar duties, respon-
8 sibilities, training, experience and other qualifications. Temporary employees
9 and agricultural inspectors referred to in subsections (n) and (p) of section
10 67-5303, Idaho Code, shall not be entitled to sick leave accruals provided in
11 section 59-1605, Idaho Code, vacation leave provided in section 59-1606, Idaho
12 Code, nor holiday pay defined in subsection (145) of section 67-5302, Idaho
13 Code, unless contributions are being made to the public employee retirement
14 system in accordance with chapter 13, title 59, Idaho Code, and rules promul-
15 gated by the retirement board. Vacation and sick leave accruals, but not holi-
16 day pay, shall be awarded retroactively, if necessary, to the date such
17 employees become eligible for retirement system membership.
18 (2) To the extent possible, each nonclassified position in the legisla-
19 tive department will be paid a salary or wage comparable to classified posi-
20 tions with similar duties, responsibilities, training, experience and other
21 qualifications.
22 (3) The supreme court shall determine the schedules of salary and compen-
23 sation for all officers and employees of the judicial department which are not
24 otherwise fixed by law. To the extent possible, the supreme court shall adopt
25 schedules which are compatible with the state's accounting system. The judi-
26 cial department may also maintain personnel records and files under such sys-
27 tem as is ordered by the supreme court.
28 (4) The state board of education shall determine the schedules of salary
29 and compensation, and prescribe policies for overtime and compensatory time
30 off from duty, for all officers and employees of the state board of education
31 who are not subject to the provisions of chapter 53, title 67, Idaho Code, and
32 which are not otherwise fixed by law. To the extent possible, the state board
33 of education shall adopt schedules and policies which are compatible with the
34 state's accounting system. The state board of education may also maintain per-
35 sonnel records and files under a system of its own, if approved by the state
36 controller.
37 (5) Members of the legislature, the lieutenant governor, other officers
38 whose salaries are fixed by law, and members of part-time boards, commissions
39 and committees shall be paid according to law.
40 (6) Any schedule of salary and compensation, if not the schedule pre-
41 scribed by section 67-5309C(a), Idaho Code, must be approved by the appointing
42 authority and be communicated to the state controller in writing at least
43 thirty (30) days in advance of the effective date of the schedule.

1 (7) In addition to salary increases provided by any compensation schedule
2 adopted pursuant to paragraph (6) of this section, nonclassified officers and
3 employees, except those who are elected officials or whose salaries are fixed
4 by law, may be granted a lump sum bonus not to exceed one thousand dollars
5 ($1,000) in any given fiscal year based upon an affirmative certification of
6 meritorious service. Exceptions to the one thousand dollar ($1,000) limit pro-
7 vided in this section may be granted if approved in advance by the state board
8 of examiners.
9 (8) In addition to salary increases provided by any compensation sched-
10 ule, nonclassified officers and employees holding permanent status, except
11 those who are elected officials or whose salaries are fixed by law, may be
12 granted a lump sum bonus not to exceed one thousand dollars ($1,000) in any
13 given fiscal year based upon suggestions or recommendations made by the
14 employee which resulted in taxpayer savings as a result of cost savings or
15 greater efficiencies to the department, office or institution or to the state
16 of Idaho in excess of the amount of the bonus. Exceptions to the one thousand
17 dollar ($1,000) limit provided in this subsection may be granted if approved
18 in advance by the state board of examiners.
19 (9) Each appointing authority, including the elective offices in the
20 executive department, the legislative department, the judicial department, and
21 the state board of education and the board of regents, shall comply with all
22 reporting requirements necessary to produce the list of employee positions
23 prescribed by section 67-3519, Idaho Code.
24 (910) The adjutant general, with the approval of the governor, shall pre-
25 scribe personnel policies for all officers and employees of the national guard
26 which are not otherwise fixed by law. Such policies will include an employee
27 grievance procedure with appeal to the adjutant general. The adjutant general
28 shall determine schedules of salary and compensation which are, to the extent
29 possible, comparable to the schedules used for federal civil service employees
30 of the national guard and those employees serving in military status. Sched-
31 ules adopted shall be compatible with the state's accounting system to the
32 extent possible.".
33 CORRECTIONS TO TITLE
34 On page 1, delete line 2 and insert: "RELATING TO COMPENSATION FOR"; in
35 line 5, delete "TO THE DEPARTMENT OR TO" and delete line 6, and insert: "; AND
36 AMENDING SECTION 59-1603, IDAHO CODE, TO PROVIDE FOR GRANTING OF BONUSES TO
37 EMPLOYEES FOR SUGGESTIONS OR RECOMMENDATIONS WHICH RESULTED IN COST SAVINGS OR
38 GREATER EFFICIENCIES AND TO PROVIDE A CORRECT CODE REFERENCE.".

STATEMENT OF PURPOSE
RS 13028
This legislation amends Idaho Code Section 67-5309C to provide
bonuses for qualifying state employees not to exceed one thousand
dollars ($1,000) in any given fiscal year based upon suggestions
or recommendations made by the employee which resulted in
taxpayer savings as a result of cost savings or greater
efficiencies to the department or to the state of Idaho in excess
of the amount of the bonus. Exceptions to the one thousand
dollar ($1,000) limit provided in this paragraph may be granted
if approved in advance by the state board of examiners.
FISCAL IMPACT
Any impact to the General Fund would be offset by the cost
savings or increased efficiencies to the department or state.
