|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1135 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO STATE BUILDINGS; AMENDING SECTION 39-4103, IDAHO CODE, TO PROVIDE 3 THAT ALL BUILDINGS AND OTHER FACILITIES OWNED BY ANY STATE GOVERNMENT 4 AGENCY OR ENTITY, OR WHICH ARE CONSTRUCTED OR RENOVATED SPECIFICALLY FOR 5 USE OR OCCUPANCY BY ANY SUCH STATE AGENCY OR ENTITY, INCLUDING THOSE 6 OWNED, CONSTRUCTED, OR FINANCED BY THE IDAHO STATE BUILDING AUTHORITY, 7 SHALL CONFORM TO THE CODES ADOPTED IN THE IDAHO BUILDING CODE ACT AND TO 8 CODES FOR PLUMBING AND ELECTRICAL WORK, AND SHALL BE SUBJECT EXCLUSIVELY 9 TO THE JURISDICTION OF THE STATE DIVISION OF BUILDING SAFETY FOR PURPOSES 10 OF ALL PLAN REVIEWS, PERMITTING AND INSPECTION; DECLARING AN EMERGENCY AND 11 PROVIDING RETROACTIVE APPLICATION. 12 Be It Enacted by the Legislature of the State of Idaho: 13 SECTION 1. That Section 39-4103, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 39-4103. SCOPE -- EXEMPTIONS. (1) This chapter authorizes the state divi- 16 sion of building safety and local governments to adopt and enforce building 17 codes pursuant to the provisions of this chapter. 18 (2) All buildings and other facilities owned by any state government 19 agency or entity, or which are constructed or renovated specifically for use 20 or occupancy by any such state agency or entity, including those owned, con- 21 structed or financed by the Idaho state building authority, shall conform to 22 the codes adopted in this chapter, chapter 26, title 54, Idaho Code, and chap- 23 ter 10, title 54, Idaho Code, and shall be subject exclusively to the juris- 24 diction of the state division of building safety for purposes of all plan 25 reviews, permitting and inspection. 26 (3) The following is exempt from the provisions of this chapter: 27 Equipment used primarily for industrial chemical process purposes and for 28 mineral extraction and mineral processing purposes. This exemption shall not 29 include the erection and fabrication of new boilers, pressure vessels and 30 other equipment as required to condition the building for personnel comfort 31 and safety. Equipment in this regard shall mean and shall be limited to facil- 32 ities or installations for heating, ventilating, air conditioning, 33 refrigerating equipment, elevators, dumbwaiters, escalators, and boilers and 34 pressure vessels associated with building heating systems. 35 SECTION 2. An emergency existing therefor, which emergency is hereby 36 declared to exist, this act shall be in full force and effect on and after its 37 passage and approval, and retroactively to January 1, 2001.
STATEMENT OF PURPOSE RS 13091 This legislation makes clear that the State Division of Building Safety has the building code enforcement responsibility (plan review, permitting and inspection) for all building facilities by state agencies including those owned, constructed or financed by the Idaho State Building Authority. FISCAL IMPACT None. The costs of the Division of Building Safety are a function of workload. Costs associated with the Idaho State Building Authority projects are paid by the Authority.
