|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1138 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE STATE ATHLETIC COMMISSION; AMENDING CHAPTER 4, TITLE 54, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 54-416A, IDAHO CODE, TO PROHIBIT 4 PROFESSIONAL OR AMATEUR TOUGHMAN, BADMAN OR ULTIMATE FIGHTING MATCHES FROM 5 BEING HELD IN THIS STATE, TO DEFINE TERMS, TO PROVIDE EXCEPTIONS, TO PRO- 6 VIDE PENALTIES AND TO PROVIDE PROCEDURES; AND DECLARING AN EMERGENCY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 4, Title 54, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 54-416A, Idaho Code, and to read as follows: 11 54-416A. TOUGHMAN, BADMAN OR ULTIMATE FIGHTING COMPETITION PROHIBITED. (1) 12 No professional or amateur toughman, badman or ultimate fighting match, as 13 described in this section, may be held in this state. Such competition 14 includes any contest or exhibition where participants compete by using a com- 15 bination of skills. Such skills may include, but are not limited to, boxing, 16 wrestling, kicking or martial arts skills. Notwithstanding the above, this 17 section shall not preclude kickboxing or mixed martial arts as regulated by 18 this chapter. 19 (2) Any person participating in or promoting a professional or amateur 20 toughman, badman or ultimate fighting match is guilty of a felony punishable 21 as prescribed by section 18-112, Idaho Code. Additionally, the athletic com- 22 mission may apply to a district court for an injunction against any and all 23 promoters of or participants in a toughman, badman or ultimate fighting match 24 and may request that the court seize all moneys and assets relating to the 25 competition. Any such moneys seized pursuant to this section shall be depos- 26 ited in the general fund. 27 SECTION 2. An emergency existing therefor, which emergency is hereby 28 declared to exist, this act shall be in full force and effect on and after its 29 passage and approval.
STATEMENT OF PURPOSE RS 12506C1 This legislation bans the promotion of or participation in Badman, Toughman, ultimate fighting and martial arts events, whether amateur or professional, with certain exceptions. Violators will be guilty of a felony. Throughout the nation, these "events" often result in serious injury and death of some participants. In 2002 a participant in one of these events in Pocatello was killed. Prohibiting such events is sound public policy. FISCAL IMPACT None. There will be costs of enforcement of criminal provision and civil enforcement provision. The legislation will also remove potential ambiguities in state law which may be misconstrued to suggest that the state may have liability for injury to participants thereby saving the state many legal expenses.
