  1                                        AN ACT
  2    RELATING TO LOBBYISTS; AMENDING SECTION 67-6617, IDAHO CODE, TO PROHIBIT  CER-
  3        TAIN  CONTRIBUTIONS  DURING ANY REGULAR OR SPECIAL SESSION OF THE LEGISLA-
  4        TURE AND TO PROVIDE PENALTIES.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 67-6617, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        67-6617.  REGISTRATION  OF  LOBBYISTS.  (a)  Before doing any lobbying, or
  9    within thirty (30) days after being employed as a lobbyist,  whichever  occurs
 10    first,  a lobbyist shall register by filing with the secretary of state a lob-
 11    byist registration statement, in such detail as the secretary of  state  shall
 12    prescribe,  accompanied  by  payment  of  a  registration  fee  of ten dollars
 13    ($10.00) (which shall be deposited by the secretary  of  state  in  the  state
 14    treasury), showing:
 15        (1)  His  name,  permanent business address, and any temporary residential
 16        and business address in Ada County during the legislative session;
 17        (2)  The name, address and general nature of the occupation or business of
 18        the lobbyist's employer, and the duration of his employment;
 19        (3)  Whether the person from whom he  receives  compensation  employs  him
 20        solely  as  a lobbyist or whether he is a regular employee performing ser-
 21        vices for his employer which include but are not limited  to  lobbying  of
 22        legislation;
 23        (4)  The  general subject or subjects of the lobbyist's legislative inter-
 24        est;
 25        (5)  The name and address of the person  who  will  have  custody  of  the
 26        accounts,  bills,  receipts,  books,  papers, and documents required to be
 27        kept under this act.
 28        (b)  Any lobbyist who receives or is to  receive  compensation  from  more
 29    than  one  (1)  person  for  his  services as a lobbyist shall file a separate
 30    notice of representation, accompanied by the fee of ten dollars  ($10.00)  for
 31    each  separate  notice  of  representation,  with respect to each such person;
 32    except that where a lobbyist whose fee for acting as such in  respect  to  the
 33    same  legislation  or type of legislation is, or is to be, paid or contributed
 34    by more than one (1) person then such lobbyist may file a single statement, in
 35    which he shall detail the name, business address  and  general  occupation  of
 36    each person so paying or contributing.
 37        (c)  Whenever  a  change,  modification,  or termination of the lobbyist's
 38    employment occurs, the lobbyist shall, within one (1)  week  of  such  change,
 39    modification  or  termination,  furnish full information regarding the same by
 40    filing with the secretary of state an amended registration statement.
 41        (d)  Each lobbyist who has registered shall file a new registration state-
 42    ment, revised as appropriate, on or before each January 10, and failure to  do
 43    so shall terminate his registration.

  1        (e)  No  lobbyist  or  any person or organization employing a lobbyist, or
  2    any political committee, shall be requested to make, nor  shall  such  persons
  3    offer  or  promise to make, a contribution to or on behalf of any candidate or
  4    candidates for state or legislative office or to or on behalf of any incumbent
  5    state officers or legislators, during any regular or special  session  of  the
  6    legislature.  Violators of this subsection shall be subject to prosecution and
  7    penalties as set forth in section 67-6625, Idaho Code.

The purpose of this act is to eliminate any appearance of
impropriety, while the legislature is in session, that may result
from lobbyists offering to make or being asked to make
contributions that benefit political candidates or political
committees.
