1 AN ACT
2 APPROPRIATING MONEYS FROM THE IDAHO MILLENNIUM INCOME FUND TO THE STATE TREA-
3 SURER FOR THE PURPOSES AND PROGRAMS SPECIFIED FOR FISCAL YEAR 2004; APPRO-
4 PRIATING MONEYS AND DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS FOR
5 THE PURPOSES AND PROGRAMS SPECIFIED FOR FISCAL YEAR 2004; PROVIDING LEGIS-
6 LATIVE INTENT TO THE CATASTROPHIC HEALTH CARE COST PROGRAM BOARD REGARDING
7 CERTAIN EXPENDITURES; AND PROVIDING THAT CERTAIN UNEXPENDED AND UNENCUM-
8 BERED MONEYS SHALL BE REVERTED.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. There is hereby appropriated from the Idaho Millennium Income
11 Fund to the State Treasurer $224,700 to be expended for trustee and benefit
12 payments for the following programs for the period July 1, 2003, through June
13 30, 2004:
14 (a) $157,200 for the American Lung Association of Idaho/Nevada to expand
15 the Not-on-Tobacco (N-O-T) smoking cessation/reduction program and the
16 Teens Against Tobacco Use (T.A.T.U.) tobacco control intervention program
17 to reach Idaho primary and secondary school students in each of the seven
18 public health districts.
19 (b) $67,500 for the Blue Cross of Idaho Foundation for Health to expand
20 and improve its current collaboration with Idaho health care providers and
21 public health districts in incorporating a Centers for Disease Control and
22 Prevention recommended tobacco control model.
23 SECTION 2. There is hereby appropriated and the State Controller is
24 hereby directed to make cash transfers from the Idaho Millennium Income Fund
25 to the following programs, at the request of the State Treasurer, not to
26 exceed $2,214,000 for the period July 1, 2003, through June 30, 2004:
27 (a) $435,000 for the Catastrophic Health Care Cost Program for tobacco-
28 related disease treatment as determined by a physician, by way of reducing
29 the county deductible payment pursuant to Section 3 of this act.
30 (b) $500,000 for the Bureau of Health Promotion in the Department of
31 Health and Welfare for targeted tobacco counter-marketing programs, spe-
32 cific to Idaho, and to be matched by private industry funds on at least a
33 one-to-one basis.
34 (c) $515,000 for the Public Health Districts to continue tobacco use ces-
35 sation programs statewide through the Public Health Districts of Idaho and
36 other nonprofit entities such as hospitals, primary care clinics and vol-
37 untary organizations. The tobacco use cessation programs should be avail-
38 able to any Idaho citizen, with primary emphasis on youth and pregnant

1 women. The program shall include strong evaluation measures including, but
2 not limited to, the number of programs funded, the number of participants
3 and quit rates.
4 (d) $270,000 for the Idaho Supreme Court for its youth courts and status
5 offender services programs as they relate to addressing tobacco and/or
6 substance abuse issues.
7 (e) $94,000 for Law Enforcement Programs in the Idaho State Police to
8 offset the cost of youth tobacco investigations.
9 (f) $400,000 for the Catastrophic Health Care Cost Program for expenses
10 related to caring for indigent persons after the $10,000 deductible is
11 paid by the counties.
12 SECTION 3. It is legislative intent that the Catastrophic Health Care
13 Cost Program Board use the funds appropriated in Section 2(a) of this act to
14 temporarily reduce the $10,000 deductible paid by counties for the costs of
15 caring for indigent persons with tobacco-related diseases. The Catastrophic
16 Health Care Cost Program Board shall be vested with the authority to define
17 and determine which cases qualify for the reduced county deductible, subject
18 to the provisions of this section. Notwithstanding the provisions of Chapter
19 35, Title 31, Idaho Code, the Catastrophic Health Care Cost Program Board is
20 hereby granted the authority to enact these reductions for the period July 1,
21 2003, through June 30, 2004, provided that the additional fiscal impact of
22 these reductions on the Catastrophic Health Care Cost Program shall not exceed
23 the amount appropriated in Section 2(a) of this act.
24 SECTION 4. Notwithstanding any other provision of law to the contrary, on
25 June 30, 2004, any remaining unexpended and unencumbered moneys appropriated
26 in Section 2 of this act shall be reverted to the Idaho Millennium Income
27 Fund.
