|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1196 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO THE APPROPRIATION FOR THE PUBLIC SCHOOLS DIVISION OF FACILITIES; 3 APPROPRIATING FUNDS TO THE EDUCATIONAL SUPPORT PROGRAM/DIVISION OF FACILI- 4 TIES FOR FISCAL YEAR 2004; TRANSFERRING AND APPROPRIATING CERTAIN FUNDS TO 5 BE EXPENDED PURSUANT TO SECTION 33-906, IDAHO CODE; DIRECTING THE DISTRI- 6 BUTION OF CERTAIN FUNDS PURSUANT TO SECTION 33-905, IDAHO CODE; DECLARING 7 AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. There is hereby appropriated to the Educational Support 10 Program/Division of Facilities, pursuant to law and the provisions of this 11 act, the following amount to be expended from the listed fund for the period 12 July 1, 2003, through June 30, 2004: 13 FROM: 14 School District Building Account $9,250,000 15 SECTION 2. The provisions of Section 33-905, Idaho Code, notwithstanding, 16 of the moneys appropriated in Section 1 of this act, $825,000 shall be trans- 17 ferred from the School District Building Account to the Bond Levy Equalization 18 Fund. There is hereby appropriated $825,000 from the Bond Levy Equalization 19 Fund, to be expended pursuant to the provisions of Section 33-906, Idaho Code. 20 SECTION 3. Any moneys appropriated in Section 1 of this act that are not 21 utilized to satisfy the provisions of Section 2 of this act, shall be distrib- 22 uted pursuant to the provisions of Section 33-905, Idaho Code. 23 SECTION 4. An emergency existing therefor, which emergency is hereby 24 declared to exist, this act shall be in full force and effect on and after 25 July 1, 2003.

This is the Fiscal Year 2004 appropriation for the Division of Facilities portion of the Public Schools budget. This portion of the budget includes two items: the funding necessary for bond levy equalization, and school building funds from lottery proceeds. Both line items in this budget are funded from lottery proceeds.
