|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 112 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO STUDY THE BEST METHODS TO IDENTIFY AND DETERMINE 4 THE NUMBER OF UNSCHOOLED CHILDREN IN IDAHO AND RECOMMEND STEPS TO INITIATE 5 OUTREACH STRATEGIES TO BRING THESE CHILDREN INTO RECOGNIZED SCHOOL SET- 6 TINGS. 7 Be It Resolved by the Legislature of the State of Idaho: 8 WHEREAS, the state of Idaho has a constitutional duty to maintain an edu- 9 cated citizenry; and 10 WHEREAS, the Idaho Department of Corrections (IDOC) has found that nearly 11 one-half of all inmates arriving at IDOC prisons do not have a high school 12 diploma nor have they completed a high school equivalency program; and 13 WHEREAS, the state of Idaho has no method or process to identify 14 unschooled children; and 15 WHEREAS, Idaho does not know the prevalence or incidence of unschooled 16 children throughout the state and has a responsibility to determine how many 17 children are unschooled and why they are not receiving schooling in some form; 18 and 19 WHEREAS, there exist numerous laws, rules, procedures and practices that 20 require all children between the ages of 6 and 16 years to be schooled and 21 receive an education. 22 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 23 of the Fifty-seventh Idaho Legislature, the Senate and the House of Represen- 24 tatives concurring therein, that the Legislative Council is authorized to 25 appoint a committee to undertake and complete a study of the best methods to 26 identify and determine the number of unschooled children in Idaho and to rec- 27 ommend steps to initiate outreach strategies to bring unschooled children into 28 one of Idaho's recognized school settings. The Legislative Council shall 29 determine the number of legislators and members from each house appointed to 30 the committee and shall authorize the committee to receive input, advice and 31 assistance from interested and affected parties who are not members of the 32 Legislature. 33 BE IT FURTHER RESOLVED upon its formation the committee shall outline and 34 adopt principles guiding the study to protect the rights of children and fami- 35 lies of children being schooled but not present in public, private or charter 36 schools. 37 BE IT FURTHER RESOLVED the committee shall seek to identify all roadblocks 38 to identification and outreach to all unschooled children and address appro- 39 priate changes to facilitate and promote schooling for all children. 40 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 41 ommendations and proposed legislation, if any, to the Second Regular Session 42 of the Fifty-seventh Idaho Legislature.
STATEMENT OF PURPOSE RS 12831C1 This proposal will direct the legislature to establish a study committee to research issues and problems regarding Idaho s unschooled children. It requires the study group to make policy recommendations to the full legislature in 2004. FISCAL IMPACT If this resolution is adopted by the Legislature and the committee is appointed, any necessary travel and per diem expense would be paid from the existing legislative appropriation to the Senate and the House of Representatives. Funding for staff support and expenses would be provided from the existing appropriation to the Legislative Council for the Legislative Services Office. There would be no additional impact upon the state general fund as a result of this resolution.
