  1                                        AN ACT
  2    RELATING TO COSMETICIANS; AMENDING  SECTION  54-804,  IDAHO  CODE,  TO  REVISE
  3        EXEMPTIONS AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  That  Section  54-804, Idaho Code, be, and the same is hereby
  6    amended to read as follows:
                                                                        
  7        54-804.  EXEMPTIONS. The provisions of this chapter shall not apply in the
  8    following instances:
  9        (1.)  Persons authorized by the laws of this state to practice as a regis-
 10    tered or practical nurse, mortician, and/or any of the healing arts, while  in
 11    the proper discharge of their professional duties.
 12        (2.)  Persons  licensed  to  practice  barbering  or  apprentice barbering
 13    barber-styling in this state.
 14        However, the provisions of this section shall not be construed  to  autho-
 15    rize  the  practice of cosmetology, except those acts that are permitted under
 16    the Idaho barber law.
 17        (3.)  Persons practicing in their own home without compensation,  and  not
 18    practicing on the public in general.
 19        (4.)  The  provisions of section 54-803(1), Idaho Code, shall not apply to
 20    licensed parties performing cosmetological services for persons unable by rea-
 21    son of ill health, medical confinement or involuntary incarceration to go to a
 22    cosmetological establishment.
 23        (5.)  The provisions of section 54-803(1), Idaho Code, shall not apply  to
 24    licensed  electrologists  or  licensed  estheticians practicing electrology or
 25    esthetics under the supervision of a person licensed as a  chiropractor,  den-
 26    tist, medical doctor or podiatrist at a facility utilized by the doctor.
 27        (6.)  Persons  whose practice is limited to the facial application of cos-
 28    metic products to customers in connection with the sale, or attempted sale, on
 29    the premises of a retail cosmetics dealer, of  cosmetic  products  at  retail,
 30    without  compensation  from  the  customer other than the regular price of the
 31    merchandise.

54-804 to strike language designating levels of nursing experience,
adding barber-styling as a designation and allow cosmetologists to
provide services for those unable to go to a cosmetological
establishment.

There will be no impact on General or Dedicated Funds.
