That Section 36-404, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 36-404. CLASSES OF LICENSES. The licenses required by the provisions of 23 this title shall be of eight (8) classes. Classes one (1) through five (5) and 24 eight (8) in this section may be purchased or obtained only by persons who 25 meet residency requirements under the provisions of section 36-202(s) and (t), 26 Idaho Code, or who are valid holders of a lifetime license certificate. 27 Class 1: Adult Combination -- Hunting -- Fishing -- Trapping Licenses. 28 Licenses to be issued only to persons who are residents of the state of Idaho. 29 Class 2: Junior Hunting -- Trapping-- Youth Small GameLicenses. 30 (a) Junior hunting license. Licenses to be issued only to persons who are 31 residents of the state of Idaho and are between twelve (12) and seventeen (17) 32 years of age, inclusive. Provided, that a license may be issued to qualified 33 persons who are eleven (11) years of age to allow the application for a con- 34 trolled hunt permit; however, said persons shall not hunt until they are 35 twelve (12) years of age. 36 (b) Junior trapping licenses. Licenses to be issued only to persons who 37 are residents of the state of Idaho and are seventeen (17) years of age or 38 younger. 39(c) Youth small game licenses. Licenses to be issued only to qualified40persons who are residents of the state of Idaho and are ten (10) or eleven41(11) years of age to hunt upland game birds (including turkeys), migratory42game birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory43birds and animals of this state while accompanied in the field by an adult2 1licensed to hunt in the state of Idaho.2 Class 3: Junior Combination -- Fishing Licenses. Licenses to be issued 3 only to persons who are residents of the state of Idaho between fourteen (14) 4 and seventeen (17) years of age, inclusive. 5 Class 4: Senior Resident Combination License. Licenses to be issued only 6 to persons over sixty-five (65) years of age who have been bona fide residents 7 of the state of Idaho for a continuous period of not less than five (5) years 8 last preceding application. 9 Class 5: Resident Lifetime Combination -- Hunting -- Fishing License. 10 Licenses to be issued only to persons who are valid holders of a lifetime 11 license certificate. 12 Class 6: Nonresident Combination -- Hunting -- Fishing -- Trapping -- Jun- 13 ior Mentored Hunting --Youth Small Game -- Youth Hunter Education Graduate --14 Licenses. Licenses required of persons who are nonresidents. 15 Class 7: Duplicate License -- Tag. A license or tag to be issued as a 16 replacement for an original license or tag lost or mutilated. Said license or 17 tag shall be issued in the same class and type as the original and upon issu- 18 ance of such duplicate license or tag the original license or tag shall become 19 null and void. 20 Class 8: Resident Hunting and Fishing License with Tags, Permits and 21 Stamps. Licenses to be issued only to persons who meet residency requirements 22 under the provisions of section 36-202(s) and (t), Idaho Code. 23 SECTION 2. That Section 36-406, Idaho Code, be, and the same is hereby 24 amended to read as follows: 25 36-406. RESIDENT FISHING, HUNTING AND TRAPPING LICENSES -- FEES. (a) 26 Adult Licenses -- Combination -- Fishing -- Hunting -- Trapping. A license of 27 the first class may be had by a person possessing the qualifications therein 28 described on payment of a fee as specified in section 36-416, Idaho Code, for 29 a combined fishing and hunting license entitling the purchaser to hunt and 30 fish for game animals, game birds, unprotected and predatory animals and fish 31 of the state, a fee as specified in section 36-416, Idaho Code, for a fishing 32 license entitling the purchaser to fish in the public waters of the state, a 33 fee as specified in section 36-416, Idaho Code, for a hunting license enti- 34 tling the purchaser to hunt game animals, game birds, unprotected and preda- 35 tory animals of the state, and a fee as specified in section 36-416, Idaho 36 Code, for a trapping license entitling the purchaser to trap furbearers, 37 unprotected and predatory animals of the state. 38 (b) Junior Licenses -- Hunting -- Trapping. A license of the second class 39 may be had by a person possessing the qualifications therein described on pay- 40 ment of a fee as specified in section 36-416, Idaho Code, for a hunting 41 license, and a fee as specified in section 36-416, Idaho Code, for a trapping 42 license entitling the purchaser to the same privileges as the corresponding 43 license of the first class provides. 44 (c) Junior Combination -- Fishing Licenses. A license of the third class 45 may be purchased by a person possessing the qualifications therein described 46 on payment of a fee as specified in section 36-416, Idaho Code, for a combined 47 fishing and hunting license, and a fee as specified in section 36-416, Idaho 48 Code, for a fishing license entitling the purchaser to the same privileges as 49 the corresponding license of the first class provides. 50 (d) Senior Resident Combination. A license of the fourth class may be had 51 by a person possessing the qualifications therein described on payment of a 52 fee as specified in section 36-416, Idaho Code, for a combined fishing and 53 hunting license entitling the purchaser to the same privileges as the corre- 3 1 sponding license of the first class provides. 2 (e) Lifetime Licenses -- Combination -- Hunting -- Fishing. A license of 3 the fifth class may be obtained at no additional charge by a person possessing 4 the qualifications therein described for a combined hunting and fishing 5 license, for a hunting license, or for a fishing license, entitling the person 6 to the same privileges as the corresponding license of the first class pro- 7 vides. Lifetime licensees must be certified under the provisions of section 8 36-4113, Idaho Code, before being issued a license to hunt. 9 (f) A license of the eighth class may be had by a person possessing the 10 qualifications therein described on payment of a fee as specified in section 11 36-416, Idaho Code, entitling the purchaser to hunt and fish for game animals, 12 game birds, fish, and unprotected and predatory animals of the state. With 13 payment of the required fee, a person shall receive with this license a deer 14 tag, an elk tag, a bear tag, a turkey tag, a mountain lion tag, an archery 15 hunt permit, a muzzleloader permit, a steelhead trout permit and an anadromous 16 salmon permit. The director shall promptly transmit to the state treasurer all 17 moneys received pursuant to this subsection for deposit as follows: 18 (i) Four dollars ($4.00) in the set-aside account for the purposes of 19 section 36-111(1)(a), Idaho Code; 20 (ii) Two dollars ($2.00) in the set-aside account for the purposes of 21 section 36-111(1)(b), Idaho Code; 22 (iii) One dollar and fifty cents ($1.50) in the set-aside account for the 23 purposes of section 36-111(1)(c), Idaho Code; and 24 (iv) The balance in the fish and game account. 25 All persons purchasing a license pursuant to this subsection shall observe 26 and shall be subject to all rules of the commission regarding the fish and 27 wildlife of the state. 28 If the purchaser of this license does not meet the archery education 29 requirements of section 36-411(b), Idaho Code, then, notwithstanding the pro- 30 visions of section 36-304, Idaho Code, the archery hunt permit portion of this 31 license is invalid. The fee for this license will not change and the license 32 must be issued without the archery permit validation. 33 (g) Disabled Persons Licenses -- Combination -- Fishing. A license of the 34 first class may be had by any resident disabled person on payment of a fee as 35 specified in section 36-416, Idaho Code, for a combined fishing and hunting 36 license, and a fee as specified in section 36-416, Idaho Code, for a fishing 37 license, entitling the purchaser to the same privileges as the corresponding 38 license of the first class provides. A disabled person means a person who is 39 deemed disabled by the railroad retirement board pursuant to title 45 of the 40 United States Code, or certified as eligible for federal supplemental security 41 income (SSI); social security disability income (SSDI); a nonservice-connected 42 veterans pension; or a service-connected veterans disability benefit with 43 forty percent (40%) or more disability. 44 (h) Military Furlough Licenses -- Combination -- Fishing. A license of 45 the first class may be had by a resident person engaged in the military ser- 46 vice of the United States, while on temporary furlough or leave, possessing 47 the qualifications therein described on payment of a fee as specified in sec- 48 tion 36-416, Idaho Code, for a combined fishing and hunting license, and as 49 specified in section 36-416, Idaho Code, for a fishing license. 50(i) Youth Small Game Licenses -- Hunting. A license of the second class51may be had by a resident of ten (10) or eleven (11) years of age on payment of52a fee as specified in section 36-416, Idaho Code, provided that the license53shall be valid only for hunting upland game birds (including turkeys), migra-54tory game birds, cottontail rabbits, pygmy rabbits, and unprotected and preda-55tory birds and animals of this state while accompanied in the field by the4 1holder of an adult Idaho hunting license.2 SECTION 3. That Section 36-407, Idaho Code, be, and the same is hereby 3 amended to read as follows: 4 36-407. NONRESIDENT COMBINATION, FISHING, HUNTING, AND TRAPPING LICENSES 5 -- FEES -- RIGHTS UNDER. Licenses of the sixth class shall be issued to non- 6 residents in the several kinds and for fees as follows: 7 (a) Nonresident Hunting License. A license issued only to a person twelve 8 (12) years of age or older entitling said person to pursue, hunt, or kill game 9 birds, small game animals, unprotected birds and animals and predatory birds 10 and animals and to purchase game tags as provided in section 36-409(b), Idaho 11 Code. Provided, that a license may be issued to qualified persons who are 12 eleven (11) years of age to allow the application for a controlled hunt per- 13 mit; however, said persons shall not hunt until they are twelve (12) years of 14 age. A license of this kind may be had upon payment of a fee as specified in 15 section 36-416, Idaho Code. 16 (b) Nonresident Season Fishing License. A license entitling a person to 17 fish in the public waters of the state. A license of this kind may be had upon 18 payment of a fee as specified in section 36-416, Idaho Code. 19 (c) Nonresident Trapping License. A license entitling a person to trap 20 fur-bearing, unprotected, and predatory animals. A license of this kind may be 21 had upon payment of a fee as specified in section 36-416, Idaho Code, provid- 22 ing the state of residence of said person grants similar trapping license 23 privileges to residents of Idaho. 24 (d) Nonresident Nongame License. A license entitling a person to carry a 25 shotgun or rifle for the protection of livestock, or to pursue, hunt and kill 26 unprotected birds and animals and predatory birds and animals of this state. A 27 license of this kind may be had by a nonresident person who is twelve (12) 28 years of age or older upon payment of a fee as specified in section 36-416, 29 Idaho Code. This license shall be valid only during the period of January 1 to 30 August 31 of the calendar year in which issued, unless verified by the direc- 31 tor that the licensee requires such a license to authorize him to carry a 32 shotgun or rifle for the protection of livestock, in which case said license 33 shall be valid until December 31 of the year in which issued. 34 (e) Nonresident Two Day Small Game Hunting License. A license issued only 35 to a person twelve (12) years of age or older, entitling the person to hunt 36 upland game birds (to include turkeys), migratory game birds, cottontail rab- 37 bits, and pygmy rabbits. A person holding this license shall purchase the 38 appropriate required tags and permits, and may not hunt pheasants in an area 39 during the first five (5) days of the pheasant season in that area. A license 40 of this type may be had upon payment of a fee as specified in section 36-416, 41 Idaho Code. 42 (f) Falconry Meet Permit. The director may issue a special permit for a 43 regulated meet scheduled for a specific number of days upon payment of a fee 44 as specified in section 36-416, Idaho Code. Only trained raptors may be used 45 under the special permit issued under the provisions of this subsection. 46 (g) Daily Fishing License -- Resident May Purchase. A license entitling a 47 person to fish in the waters of the state on a day-to-day basis. A license of 48 this kind may be had by a resident or nonresident person (the provisions of 49 section 36-405, Idaho Code, notwithstanding), upon payment of a fee as speci- 50 fied in section 36-416, Idaho Code, for the first effective day and a fee as 51 specified in section 36-416, Idaho Code, for each consecutive day thereafter. 52 (h) Nonresident Three Day Fishing License with Steelhead or Salmon Per- 53 mit. A license entitling a nonresident to fish in the waters of the state for 5 1 a period of three (3) consecutive days for any fish, including steelhead trout 2 or anadromous salmon during an open season for those fish may be had upon 3 payment of a fee as specified in section 36-416, Idaho Code. The three (3) day 4 license holder may fish for any species of fish, steelhead trout and anadro- 5 mous salmon subject to the limitations prescribed in rules promulgated by the 6 commission. A nonresident may purchase as many of the licenses provided in 7 this subsection as he desires provided that the nonresident is otherwise eli- 8 gible to do so. 9 (i) Nonresident Junior Fishing License. A license entitling a nonresident 10 who is less than eighteen (18) years of age to fish in the waters of this 11 state may be had upon payment of a fee as specified in section 36-416, Idaho 12 Code. 13 (j) Nonresident Combination Licenses. A license entitling the person to 14 hunt and fish for game animals, game birds, fish and unprotected and predatory 15 animals of the state may be had by a person twelve (12) years of age or older 16 upon payment of a fee as specified in section 36-416, Idaho Code. A license 17 may be issued to a qualified person who is eleven (11) years of age to allow 18 the application for a controlled hunt permit; however, the person shall not 19 hunt until he is twelve (12) years of age. 20 (k) Nonresident Junior Mentored Hunting License. A license entitling a 21 nonresident between twelve (12) and seventeen (17) years of age, inclusive, to 22 hunt game animals, upland game birds (including turkeys), migratory game 23 birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory birds 24 and animals of this state only when accompanied in the field by the holder of 25 an adult Idaho hunting license. A person holding this license shall purchase 26 the appropriate required tags as provided in section 36-409(b), Idaho Code, 27 and permits. Provided, that a license may be issued to qualified persons who 28 are eleven (11) years of age to allow the application for a controlled hunt 29 permit; however, said persons shall not hunt until they are twelve (12) years 30 of age. A license of this kind may be had upon payment of a fee as specified 31 in section 36-416, Idaho Code. 32(l) Nonresident Youth Small Game Licenses -- Hunting. A license entitling33a nonresident of ten (10) or eleven (11) years of age to hunt upland game34birds (including turkeys), migratory game birds, cottontail rabbits, pygmy35rabbits, and unprotected and predatory birds and animals of this state only36while accompanied in the field by the holder of an adult Idaho hunting license37may be had upon payment of a fee as specified in section 36-416, Idaho Code.38(m) Youth Hunter Education Graduate Licenses -- Hunting -- Resident May39Purchase. A license entitling a person between ten (10) and seventeen (17)40years of age, inclusive, to hunt upland game birds (except turkeys), migratory41game birds, cottontail rabbits, pygmy rabbits, and unprotected and predatory42birds and animals of this state only when accompanied in the field by the43holder of an adult Idaho hunting license. A person holding this license shall44purchase the appropriate required permits. A license of this kind may be45issued to a resident or nonresident person, notwithstanding the provisions of46section 36-405, Idaho Code, upon payment of a fee as specified in section4736-416, Idaho Code.48 SECTION 4. That Section 36-412, Idaho Code, be, and the same is hereby 49 amended to read as follows: 50 36-412. EDUCATION PROGRAMS -- INSTRUCTOR QUALIFICATIONS -- FEE. (a) The 51 fish and game commission shall prescribe and administer education programs in 52 hunting and archery. Such programs shall provide instruction in the safe 53 handling of lawful hunting equipment. The programs shall also include instruc- 6 1 tion on wildlife and natural resource conservation, good conduct and respect 2 for the rights and property of others, and survival in the outdoors. The com- 3 mission may enter into agreements with public or private agencies and individ- 4 uals in carrying out the provisions of this subsection. 5 (b) The department of fish and game shall recruit competent volunteer 6 instructors. The department shall provide training for the instructors in the 7 safe handling of legal hunting equipment, conservation of wildlife and natural 8 resources, good conduct and respect for the rights and property of others, 9 outdoor survival, and other appropriate subjects for training instructors. 10 Instructors shall be issued certificates and shall on a voluntary basis, give 11 instruction in education programs as established by the department of fish and 12 game, to all eligible applicants. 13 (c) The commission shall establish fees for each program not to exceed 14 eight dollars ($8.00) for persons who are age seventeen (17) years and under 15 and not to exceed eight dollars ($8.00) for persons age eighteen (18) years 16 and older, to be assessed each individual obtaining instruction in hunter edu- 17 cation for reimbursement for furnished materials. All students successfully 18 completing the course of instruction shall be issued a certificate of comple- 19 tion in hunter safety and good hunting conduct. The department may alsoissue20a youth hunter education graduate hunting license to students successfully21completing the course orallowthestudents successfully completing the 22 course, who are otherwise qualified to purchase a junior hunting license, to 23 purchasea junior huntingthe license at a reduced fee pursuant to rules 24 adopted by the commission. 25 SECTION 5. That Section 36-416, Idaho Code, be, and the same is hereby 26 amended to read as follows: 27 36-416. Notwithstanding any other provision of this 21 act, any person who, on the date of passage and approval of this act, holds a 22 valid youth small game license and/or a youth hunter education graduate 23 license heretofore issued under the laws of this state, shall, for all pur- 24 poses be considered licensed under the laws of the state of Idaho pending 25 expiration of the license on December 31, 2003, unless such license is other- 26 wise earlier suspended or revoked pursuant to law. 27 SECTION 7. That Section 36-1508, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 36-1508. SHOOTING FROM PUBLIC HIGHWAY -- CHILDREN IN POSSESSION OF FIRE- 30 ARMS. No person shall: 31 (a) Shoot from Public Highway. Discharge any firearm from or across a 32 public highway. 33 (b) Children with Firearms. No person under the age of twelve (12) years 34 shall have in his possession any shotgun, rifle or other firearm while in the 35 fields or forests or in any tent, camp, auto or any other vehicle in the state 36 of Idaho, except that the holder of a youth small game license or youth hunter37education graduate license, if accompanied by an adult licensed to hunt in the38state of Idaho, may possess a firearm for hunting while in the fields or for-39ests. 40 SECTION 8. An emergency existing therefor, which emergency is hereby 41 declared to exist, this act shall be in full force and effect on and after its 42 passage and approval, and retroactively to January 1, 2003.
STATEMENT OF PURPOSE RS12622 This legislation would amend Section 36-404, Idaho Code, to set the age of youth at 12 years to qualify to purchase youth small game licenses.
