|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 120 BY TRAIL 1 AN ACT 2 RELATING TO TRAVEL PAY AND ALLOWANCES; AMENDING CHAPTER 23, TITLE 67, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 67-2358, IDAHO CODE, TO PROVIDE 4 THAT CITIES, COUNTIES AND OTHER POLITICAL SUBDIVISIONS OF THE STATE SHALL 5 FIX RATES OF ALLOWANCE FOR PER DIEM SUBSISTENCE AND MILEAGE AND TO PROVIDE 6 THAT IF NO SUCH RATES ARE FIXED THE RATES SET BY THE STATE BOARD OF EXAM- 7 INERS FOR STATE EMPLOYEES SHALL APPLY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 23, Title 67, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 67-2358, Idaho Code, and to read as follows: 12 67-2358. STANDARD TRAVEL PAY AND ALLOWANCES FOR POLITICAL SUBDIVISIONS. 13 All cities, counties and other political subdivisions of the state shall fix 14 rates of allowance for per diem subsistence and mileage for officers, agents 15 and all other employees of such political subdivisions who are absent from 16 their posts of duty on official business, provided that if no such rates are 17 fixed by the political subdivision, the rates set by the state board of exam- 18 iners for employees of the state shall apply to the political subdivision.
STATEMENT OF PURPOSE RS12566C1 This legislation would amend Chapter 23, Title 67, Idaho Code with the addition of a new section, to be known as Section 67 2358. This section would require that all cities, counties and other political subdivisions of the state shall fix rates of allowance for per diem subsistence and mileage for officers, agents and all other employees of such political subdivisions who are absent from their posts of duty on official business. Such rates shall not exceed those rates set by the state board of examiners, for employees of the state, unless the local political subdivision sets policy so directing.
