vehicles shall not apply to any trailer not wider than the implement of
husbandry used in the transportation of implements of husbandry for
agricultural operations; and to delete the twenty-five mile per hour speed
limit for farm tractors or implements of husbandry.

1 AN ACT
2 RELATING TO IMPLEMENTS OF HUSBANDRY; AMENDING SECTION 49-1010, IDAHO CODE, TO
3 PROVIDE THAT LIMITATIONS AS TO SIZE OF VEHICLES SHALL NOT APPLY TO ANY
4 TRAILER NOT WIDER THAN THE IMPLEMENT OF HUSBANDRY USED IN THE TRANSPORTA-
5 TION OF IMPLEMENTS OF HUSBANDRY FOR AGRICULTURAL OPERATIONS, TO DELETE THE
6 TWENTY-FIVE MILE PER HOUR SPEED LIMIT FOR FARM TRACTORS OR IMPLEMENTS OF
7 HUSBANDRY AND TO MAKE TECHNICAL CORRECTIONS.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 49-1010, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 49-1010. SIZE OF VEHICLES AND LOADS. No vehicle shall exceed the dimen-
12 sions specified below, except that certain devices determined by the board as
13 necessary for the safe and efficient operation of motor vehicles, including
14 energy conservation devices, shall be excluded from the calculation of width
15 or length.
16 (1) The width of a vehicle, including any load thereon, except as noted
17 below, shall not exceed .......................................... 8 1/2 feet.
18 (a) The limitations as to size of vehicles stated in this section shall
19 not apply to farm tractors or to implements of husbandry, including any
20 load thereon, or any trailer not wider than the implement of husbandry
21 used in the transportation of implements of husbandry for agricultural
22 operations, and including all equipment used in land leveling operations,
23 when being incidentally operated upon the highway from one (1) farm opera-
24 tion to another during daylight hours.
25 (b) Notwithstanding the exemption from width limitation for farm tractors
26 included in paragraph (a) of this subsection, the total outside width of
27 any farm tractor being transported on the interstate system in this state,
28 except as permitted by section 49-1004, Idaho Code, shall not exceed
29 .................................................................. 9 feet.
30 (c) A farm tractor or implement of husbandry, when being incidentally
31 transported upon the highway with a width in excess of the limits of para-
32 graphs (a) and (b) of this subsection, must not proceed at a speed in
33 excess of twenty-five (25) miles per hour, must display one (1) red or
34 fluorescent orange flag a minimum of twelve (12) by twelve (12) inches on
35 the outermost left projection of the tractor or implement being trans-
36 ported, except that the speed restriction of twenty-five (25) miles per
37 hour shall not apply when such tractor or implement of husbandry is being
38 hauled on legal width highway vehicles equipped as required by law.
39 (2) The height of a vehicle, including the load thereon, shall not exceed
40 ..................................................................... 14 feet.
41 (3) The length of a vehicle, or vehicle combination, except as noted
42 below shall not exceed:
43 (a) When a single motor vehicle ................................ 45 feet.

1 (b) When a trailer or semitrailer, except as noted below ....... 48 feet.
2 1. Semitrailers operating on routes determined by the board to have
3 severe curvature, deficient width and/or heavy traffic conditions
4 shall be limited to an overall combination length not to exceed
5 ............................................................ 65 feet.
6 2. The length of a trailer tongue, or the length of the tongue of a
7 converter gear used to convert a semitrailer to a trailer, shall be
8 excluded from the calculation of a trailer length.
9 3. Semitrailers operating on routes which are a part of the national
10 network as set forth in the Code of Federal Regulations, Title 23,
11 Part 23 CFR 658, on routes providing access between the national net-
12 work and terminals and facilities for food, fuel, repairs and rest
13 which are located within one (1) road mile of the national network
14 and state highways as set forth by policy and approved by the trans-
15 portation board shall not exceed a length of ..................... 53

17 (c) When a motor vehicle and one (1) or more trailers, except as noted in
18 subsections (3)(b), (3)(d) and (3)(e) of this section ........... 75 feet.
19 (d) When a combination of semitrailer and trailer, or of two (2) semi-
20 trailers the length in such combination, including the connecting tongue
21 and excluding the truck tractor except as noted below ........... 61 feet.
22 When the combination of semitrailer and trailer or of two (2) semi-
23 trailers including the connecting tongues exceeds sixty-one (61) feet, the
24 length of such combination including the truck tractor .......... 75 feet.
25 (e) When a combination of a semitrailer and trailer, or of two (2) semi-
26 trailers operating on routes on the national network as set forth in the
27 Code of Federal Regulations, Title 23, Part 23 CFR 658, and on routes pro-
28 viding access between the national network and terminals and facilities
29 for food, fuel, repairs and rest which are located within one (1) road
30 mile of the national network, the length, including the connecting tongue
31 and excluding the truck tractor, shall not exceed ............... 68 feet.
32 (f) When a dromedary tractor with semitrailer, stinger-steered by having
33 the kingpin located five (5) feet to the rear of the centroid of the rear
34 axle(s) ......................................................... 75 feet.
35 (g) When a dromedary tractor with semitrailer, not meeting the stinger-
36 steer requirement as defined in subsection (3)(f) of this section .... 65
37 feet.
38 (h) When an auto transporter or boat transporter, stinger-steered
39 as defined in subsection (3)(f) of this section, excluding front and
40 rear overhang of load ........................................ 75 feet.
41 (i) When an auto transporter or boat transporter, not meeting the
42 stinger-steer requirement as defined in subsection (3)(f) of this section,

4 (5) Noncargo-carrying devices necessary for the safe and efficient opera-
5 tion of the vehicle, as determined by the board, shall not be included in mea-
6 surement for length.
7 (6) No combination shall include more than three (3) units except when a
8 saddlemount combination ............................................. 75 feet.
9 (7) Vehicle combinations consisting of not more than four (4) vehicle
10 units with an overall length in excess of the limits of subsection (3) of this
11 section and with an overall combination length not to exceed one hundred and
12 five (105) feet, may be operated by permit on routes designated for such oper-
13 ations by the public highway agency having jurisdiction over that highway sys-
14 tem.
STATEMENT OF PURPOSE
RS 12534
This legislation clarifies that trailers used for hauling
agricultural implements are exempt from the 8« foot width
limitation included in Idaho Statute 49-1010. Modern implements
of husbandry like swathers are often up to 15 foot wide and it is
the intent of this legislation to exempt all trailers that are
used exclusively to haul such implements for agricultural
operations.
Part C of this proposal is to remove the 25 mph limit on tractors
or implements being transported on highways but requiring that
such tractors or implements display a red or orange flag a
minimum of twelve (12) by twelve (12) inches on the outermost
left projection of the tractor or implement.
