|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 153 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO STUDENTS CALLED TO ACTIVE MILITARY DUTY; AMENDING CHAPTER 37, 3 TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-3723, IDAHO 4 CODE, TO REQUIRE THAT THE STATE BOARD OF EDUCATION AND BOARD OF REGENTS OF 5 THE UNIVERSITY OF IDAHO ADOPT PROTECTIONS FOR STUDENTS CALLED TO ACTIVE 6 MILITARY DUTY; AND DECLARING AN EMERGENCY. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 37, Title 33, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 33-3723, Idaho Code, and to read as follows: 11 33-3723. PROTECTION FOR DEPLOYED STUDENTS. It is the finding of the leg- 12 islature that the public interest is served by according maximum support to 13 our young men and women enrolled in institutions of postsecondary education in 14 this state who are called to active military duty. To further this support, 15 the state board of education and the board of regents of the university of 16 Idaho shall adopt a policy applicable to all institutions under their adminis- 17 tration which guarantees: 18 (1) Every deployed student shall receive a full refund of fees for ma- 19 triculation, books, parking permits, unused campus housing and meal plans, and 20 other college or university costs associated with academic credit for the term 21 enrolled at the time of deployment. 22 (2) No college or university student shall receive failing marks on his 23 or her transcript due to deployment occurring after standard withdrawal dead- 24 lines. 25 (3) Any credit a deployed student earned toward graduation shall still 26 apply toward graduation upon return of the deployed student, notwithstanding 27 changes in the program requirements. 28 (4) At the option of the student, with concurrence of the instructor, if 29 a substantial amount of the academic period has passed, the deployed student 30 may choose a grade based on work completed up to the time of the deployment in 31 lieu of refunds. 32 The state board of education and the board of regents of the university of 33 Idaho is authorized to adopt rules implementing the provisions of this sec- 34 tion. 35 SECTION 2. An emergency existing therefor, which emergency is hereby 36 declared to exist, this act shall be in full force and effect on and after its 37 passage and approval.
STATEMENT OF PURPOSE RS 12815C1 This proposal adds a new section to Idaho Code 33-3723 to protect students that are called to active military duty from financial loss of expenses associated with postsecondary education. Deployed students are further protected from failing marks on their transcript due to missed class assignments. FISCAL IMPACT No fiscal impact on the general fund. Contact Name: Rep.
