  1                                        AN ACT
  2    RELATING TO THE MARKETING OF AGRICULTURAL PRODUCTS; AMENDING CHAPTER 1,  TITLE
  3        22,  IDAHO  CODE,  BY THE ADDITION OF A NEW SECTION 22-111, IDAHO CODE, TO
  4        AUTHORIZE THE DEPARTMENT OF AGRICULTURE TO PROMULGATE  RULES  RELATING  TO
  5        THE SALE OF AGRICULTURAL PRODUCTS AND TO PROVIDE FOR CERTAIN FEES; DECLAR-
  6        ING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  1,  Title  22, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 22-111, Idaho Code, and to read as follows:
                                                                        
 11        22-111.  MARKETING OF IDAHO AGRICULTURAL PRODUCTS. The department of agri-
 12    culture  may  promulgate  rules in compliance with chapter 52, title 67, Idaho
 13    Code, relating to the domestic and international sale of agricultural products
 14    including, but not limited to, provisions for the development and  implementa-
 15    tion  of  marketing  programs and the imposition of reasonable fees associated
 16    with the services and programs provided for by rule.  Fees  imposed  and  col-
 17    lected  pursuant to rules authorized by this section shall be deposited in the
 18    agricultural department inspection fund and subject to the provisions of  sec-
 19    tion 22-105, Idaho Code.
                                                                        
 20        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 21    declared to exist, this act shall be in full force and effect on and after May
 22    1, 2003.

                       STATEMENT OF PURPOSE
                            RS 12673C1
     Add section 22-111, to Chapter 1, Title 22, Idaho Code, to
provide for the development of rules to support the marketing of
Idaho agricultural products.  The proposed legislation will allow
the Department to develop and implement programs that will assist
in the domestic and international sale of agricultural products. 
There have been growing opportunities for niche markets,
speciality products and identity preserved products.  Many
domestic and international buyers, however, are requiring
additional documentation and government certification of such
products.  This legislation will allow Idaho producers to meet
the requirements and take advantage of these market
opportunities.  
     In addition, the Department is launching a product identity
campaign.  This legislation will provide for the rules necessary
to govern the mark developed in conjunction with the campaign. 
An emergency clause is necessary because the promotional campaign
will be ready to launch this summer and time will be needed to
recruit companies and growers into the program.  The emergency
clause will also allow the Department to provide for new products
or opportunities that arise between May 1 and July 1.
                          FISCAL IMPACT
There will be no impact to general fund.  Any fiscal impact to
Idaho producers will vary depending upon the program.
