BY RESOURCES AND CONSERVATION COMMITTEE
1 AN ACT
2 RELATING TO OPERATION OF VESSELS; AMENDING SECTION 67-7077, IDAHO CODE, TO
3 REVISE WHAT CONSTITUTES UNLAWFUL OPERATION OF VESSELS ON THE WATERS OF
4 THIS STATE.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 67-7077, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 67-7077. OPERATION OF VESSELS. It shall be unlawful for any person to
9 operate any vessel on the water of this state:
10 (a) in a negligent manner as prescribed in section 67-7017, Idaho Code,
11 while within one hundred (100) feet of another vessel; or (b) at At a speed
12 greater than no wake or five (5) miles per hour while within one hundred (100)
13 feet of a dock, swimmer or other person in the water, except when safely pull-
14 ing a water skier from a dock, or when safely dropping off a water skier who
15 is twelve (12) years of age or younger at or near a dock, or when the swimmer
16 or other person in the water is the vessel's water skier.
17 (b) When dropping off a skier at or near a dock all efforts shall be made
18 to reasonably minimize the time and distance the vessel shall travel inside
19 the one hundred (100) foot zone while operating at speeds greater than no wake
20 or five (5) miles per hour.

1 AMENDMENTS TO SECTION 1
2 On page 1 of the printed bill, delete lines 10 and 11 and insert:
3 "(a) iIn a negligent manner as prescribed in section 67-7017, Idaho Code,
4 while within one hundred (100) feet of another vessel; or
5 (b) aAt a speed";
6 and in line 17, delete "(b)" and insert: "(c)".

STATEMENT OF PURPOSE

The purpose of this legislation would allow a person operating a
vessel to exceed the no-wake limit if they are safely pulling a
skier from a dock or dropping a skier off near a dock.
The operator of the vessel shall make a reasonable effort to minimize
the time and distance traveled in the no-wake zone while engaged in
these activities.
