|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 187 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC SCHOOL DISTRICT EARLY RETIREMENT INCENTIVES; REPEALING SEC- 3 TION 33-1004G, IDAHO CODE; AND DECLARING AN EMERGENCY. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 33-1004G, Idaho Code, be, and the same is hereby 6 repealed. 7 SECTION 2. An emergency existing therefor, which emergency is hereby 8 declared to exist, this act shall be in full force and effect on and after its 9 passage and approval.
STATEMENT OF PURPOSE RS12525C1 This legislation will eliminate the early retirement incentive as provided in Chapter 33-1004G of the Idaho Code that is paid to certificated employees of an Idaho public school district. The intent of the legislation when passed in 1996 was to give teachers who were "no longer performing at their peak level" and did not want to become technologically prepared, an avenue to leave the teaching profession early. The premise was that we could save enough when certified employees at the top end of the salary apportionment schedule departed and new employees at the bottom end of the schedule were hired, to pay for the costs incurred by Chapter 33-1004G of the Idaho Code. However, as time has elapsed, the law has not worked as originally visualized and needs to be repealed. FISCAL IMPACT The exact fiscal impact is impossible to ascertain.
