  1                                        AN ACT
  2    RELATING TO INDEPENDENT CANDIDATES; AMENDING SECTION 34-708,  IDAHO  CODE,  TO
  3        PROVIDE  THAT  A DECLARATION OF CANDIDACY AS AN INDEPENDENT CANDIDATE MUST
  4        BE FILED DURING THE PERIOD SPECIFIED IN SECTION 34-704, IDAHO CODE AND  TO
  5        MAKE A TECHNICAL CORRECTION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  34-708, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        34-708.  INDEPENDENT CANDIDATES. (1) No person may  offer  himself  as  an
 10    independent candidate at the primary election.
 11        (2)  Any  person  who desires to offer himself as an independent candidate
 12    for federal, state, district, or county office may do so by complying strictly
 13    with the provisions of this section. In order to be recognized as an  indepen-
 14    dent  candidate, each such candidate must file with the proper officer as pro-
 15    vided by section 34-705, Idaho Code, a declaration of candidacy as an indepen-
 16    dent candidate, between 8 a.m. on the tenth Monday preceding the primary elec-
 17    tion and 5 p.m. on the eighth Friday preceding the primary election during the
 18    period specified in section 34-704, Idaho Code. Such  declaration  must  state
 19    that  he is offering himself as an independent candidate, must declare that he
 20    has no political party affiliation, and must declare the office for  which  he
 21    seeks  election.  Each such declaration must be accompanied by a petition con-
 22    taining the following number of signatures of qualified electors:
 23        (a)  One thousand (1,000) for any statewide office;
 24        (b)  Five hundred (500) for any congressional district office;
 25        (c)  Fifty (50) for any legislative district office;
 26        (d)  Five (5) for any county office;.
 27        (3)  Signatures on the petitions required in this section shall  be  veri-
 28    fied in the manner prescribed in section 34-1807, Idaho Code.
 29        (4)  If  all of the requirements of this section have been met, the proper
 30    officer shall cause the name of each independent candidate who  has  qualified
 31    to  be placed on the general election ballot, according to instructions of the
 32    secretary of state.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13203
The purpose of this legislation is to bring the filing date for
independent candidates in line with the date that was changed in
Chapter 48 of the 2003 Session Laws.
                          FISCAL IMPACT
No fiscal impact to the state general fund.
