  1                                        AN ACT
  2    RELATING TO CONFIDENTIALITY OF RECORDS RELATING TO  JUDICIAL  PROCEEDINGS  FOR
  3        STERILIZATION;  AMENDING  SECTION  39-3913,  IDAHO CODE, AS ADDED BY HOUSE
  4        BILL 213, AS ENACTED BY THE FIRST REGULAR  SESSION  OF  THE  FIFTY-SEVENTH
  5        IDAHO  LEGISLATURE,  TO PROVIDE REPORTS TO BE PREPARED AND RELEASED TO THE
  6        PUBLIC.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 39-3913, Idaho Code, as added by House Bill  213,
  9    as  enacted  by  the First Regular Session of the Fifty-seventh Idaho Legisla-
 10    ture,  be, and the same is hereby amended to read as follows:
                                                                        
 11        39-3913.  CONFIDENTIALITY OF AND ACCESS TO RECORDS. (1) Records  developed
 12    by  the  evaluation committee and records contained in court files of judicial
 13    proceedings brought under this chapter shall be governed by the provisions  of
 14    chapter 3, title 9, Idaho Code.
 15        (2)  The  administrative  director  of the courts shall compile statistics
 16    for each calendar year, accessible to the public, including:
 17        (a)  The total number of petitions filed pursuant to this chapter;
 18        (b)  The number of petitions in which the evaluation committee recommended
 19        a procedure and the number of petitions in which the evaluation  committee
 20        recommended against a procedure;
 21        (c)  The number of petitions granted by the court;
 22        (d)  For  categories  described  in paragraphs (b) and (c) of this subsec-
 23        tion, the number of appeals taken from the court's order in each category;
 24        and
 25        (e)  For each of the categories set out in paragraph (d) of  this  subsec-
 26        tion,  the  number  of  cases  for  which  the  district court's order was
 27        affirmed and the number of cases for which the district court's order  was
 28        reversed.

                       STATEMENT OF PURPOSE
                             RS 13165
The purpose of this legislation is to require that the court
compile statistics relating to sterilization in accordance with
the law.
                          FISCAL IMPACT

There is no cost to the general fund.
