TRUCK WEIGHTS - Stating findings of the Legislature and requesting the
Congress of the United States to eliminate the preemption under the 1991
Intermodal Surface Transportation Efficiency Act (ISTEA) which prevents
Idaho from determining truck weights on interstate highways within its
jurisdiction and allow Idaho to fulfill its obligation to its citizens to
promote efficient freight transportation on all Idaho highways.

2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS
3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
4 IDAHO IN THE CONGRESS OF THE UNITED STATES.
5 We, your Memorialists, the House of Representatives and the Senate of the
6 State of Idaho assembled in the First Regular Session of the Fifty-seventh
7 Idaho Legislature, do hereby respectfully represent that:
8 WHEREAS, since congressional enactment of the 1991 Intermodal Surface
9 Transportation Efficiency Act (ISTEA), states of the United States, including
10 Idaho, have been preempted by operation of Section 1023 of ISTEA, from deter-
11 mining truck combination weights on the Interstate Highway System within their
12 respective jurisdictions; and
13 WHEREAS, this has prevented Idaho shippers, consumers, motor carriers and
14 motorists from realizing any of the benefits inherent in a greater use of
15 longer combination vehicles, among which are reduction in truck traffic,
16 reduction in axle weights, extension of pavement life, reduction in exhaust
17 emissions, reduction in traffic fatalities, reduction in shipping costs, and
18 improved economic competitiveness with states that had more efficient combina-
19 tions in effect at the time the arbitrary date for change was set; and
20 WHEREAS, Idaho must have the advantages of such benefits as cited and, in
21 addition, must have the flexibility to set combination weights for routes,
22 currently unbuilt, but which might be built prior to the time the next federal
23 highway bill expires; and
24 WHEREAS, it must be conceded that the "freeze" has not resulted in any
25 benefit for the federal government or any state and has no potential to be of
26 any benefit if it were allowed to continue; and
27 WHEREAS, the prestigious regional organization of which the state of Idaho
28 is such an integral part, the Multistate Highway Transportation Agreement,
29 has, since the enactment of the "freeze," called for an end to this mandate;
30 and
31 WHEREAS, Special Report No. 267, released in 2002 by the distinguished
32 Transportation Research Board, calls for states to become progressive with
33 their truck size and weight laws, in conformance with the federal bridge for-
34 mula B, an act that cannot be achieved without an end to the "freeze."
35 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
36 of the Fifty-seventh Idaho Legislature, the House of Representatives and the
37 Senate concurring therein, that we urge the federal government to eliminate
38 the preemption which prevents Idaho from determining truck weights on inter-
39 state highways within its jurisdiction and allow Idaho to fulfill its obliga-
40 tion to its citizens to promote efficient freight transportation on all Idaho
41 highways.
42 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa-
43 tives be, and she is hereby authorized and directed to forward a copy of this
44 Memorial to the President of the Senate and the Speaker of the House of Repre-

1 sentatives of Congress, and the congressional delegation representing the
2 State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE

Memorial to Senate and House of the United States Congress
assembled and to Idaho's Congressional Delegation to lift the
freeze imposed by 1991 Intermodal Surface Transportation Act
(ISTEA)now T-21 on a states right to determine truck combination
weight on the Interstate Highway System within their respective
jurisdictions.
Special Report No. 267, released in 2002 by the distinguished
Transportation Board, calls for states to become progressive with
their truck size and weight laws, in conformance with the federal
bridge formula B, an act that cannot be achieved without an end
to the "freeze."
