|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 6 BY WAYS AND MEANS COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the First Regular Session of the Fifty-seventh 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, our United States was founded on the "self-evident" truths that 9 rights are granted by God, that governments exist only to protect those 10 rights, and that God-given rights cannot legitimately be canceled; and 11 WHEREAS, the Declaration of Independence of 1776 proclaims: "We hold these 12 truths to be self-evident, that all men are created equal, that they are 13 endowed by their Creator with certain unalienable Rights, that among these are 14 Life, Liberty and the pursuit of Happiness. That to secure these rights, Gov- 15 ernments are instituted among Men, deriving their just powers from the consent 16 of the governed"; and 17 WHEREAS, the United Nations refuses to recognize God, declares that rights 18 exist by virtue of laws enacted by governments, and claims power unto itself 19 to suspend such laws; and 20 WHEREAS, the fundamental founding document of the United Nations is the 21 United Nations' Charter and its primary documents constituting its Interna- 22 tional Bill of Rights are the Universal Declaration of Human Rights; the 23 International Convention on Rights of the Child, the International Covenant on 24 Economic, Social, and Cultural Rights, and the International Covenant on Civil 25 and Political Rights, none of which contain any mention of God. The Universal 26 Declaration of Human Rights, adopted and proclaimed by the United Nations Gen- 27 eral Assembly in 1948, provides: "In the exercise of his rights and freedoms, 28 everyone shall be subject only to such limitations as are determined by 29 law...These rights and freedoms may in no case be exercised contrary to the 30 purposes and principles of the United Nations"; and 31 WHEREAS, in regard to the issue of Rights, the Bill of Rights as set forth 32 in the Constitution of the United States stands in contrast to the United 33 Nations' International Bill of Rights; and 34 WHEREAS, in regard to the issue of Freedom of Religion, the First Amend- 35 ment to the Constitution of the United States provides that: "Congress shall 36 make no law respecting an establishment of religion, or prohibiting the free 37 exercise thereof...." Article 18 of the United Nations' International Covenant 38 on Civil and Political Rights provides that: "Everyone shall have the right to 39 freedom of...religion....Freedom to manifest one's religion or beliefs may be 40 subject only to such limitations as are prescribed by law and are necessary to 41 protect public safety, order, health, or morals or the fundamental rights and 42 freedoms of others"; and 43 WHEREAS, in regard to the issue of Freedom of Speech, the First Amendment 44 of the Constitution of the United States provides that: "Congress shall make 2 1 no law...abridging the freedom of speech, or of the press...." Article 19 of 2 the United Nations' International Covenant on Civil and Political Rights pro- 3 vides that: "Everyone shall have the right to hold opinions without interfer- 4 ence. Everyone shall have the right to freedom of expression....The exercise 5 of the rights...may therefore be subject to certain restrictions, but these 6 shall only be such as are provided by law...."; and 7 WHEREAS, in regard to the issue of Freedom of Assembly, the First Amend- 8 ment of the Constitution of the United States provides that: "Congress shall 9 make no law...abridging...the right of the people peaceably to assemble...." 10 Article 21 of the United Nations' International Covenant on Civil and Politi- 11 cal Rights provides that: "The right of peaceful assembly shall be recognized. 12 No restrictions may be placed on the exercise of this right other than those 13 imposed in conformity with the law...."; and 14 WHEREAS, in regard to the issue of the Right to Bear Arms, the Second 15 Amendment of the Constitution of the United States provides that: "A well reg- 16 ulated militia, being necessary to the security of a free state, the right of 17 the people to keep and bear arms, shall not be infringed." The United Nations 18 stands silent on this right; and 19 WHEREAS, in regard to the right to Public Trial By Jury, the Sixth Amend- 20 ment of the Constitution of the United States provides that: "In all criminal 21 prosecutions, the accused shall enjoy the right to a speedy and public trial, 22 by an impartial jury...." Article 14 of the United Nations' International Cov- 23 enant on Civil and Political Rights provides that: "The press and the public 24 may be excluded from all or part of a trial...."; and 25 WHEREAS, Article 29 of the United Nations' International Covenant on Civil 26 and Political Rights provides that: "In the exercise of his rights and 27 freedoms, everyone shall be subject only to such limitations as are determined 28 by law...". 29 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 30 of the Fifty-seventh Idaho Legislature, the House of Representatives and the 31 Senate concurring therein, that we respectfully urge the Congress of the 32 United States to use appropriate constitutional authority in order to extri- 33 cate our nation from the threat to freedom posed by the United Nations. We 34 encourage House members to work toward this goal by co-sponsoring H.R. 1146, 35 "The American Sovereignty Restoration Act." We encourage Idaho's Senators to 36 introduce a similar measure in the United States Senate. 37 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 38 tives be, and she is hereby authorized and directed to forward a copy of this 39 Memorial to the President of the Senate and the Speaker of the House of Repre- 40 sentatives of Congress, and the congressional delegation representing the 41 State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS 12948 The purpose of this legislation is to suggest that the United States Congress remove the United States from the United Nations. The lack of support from Germany and France in the current debate over terrorism and Iraq is based on their financial gain. Therefore, their mandates are ineffective and lack moral authority. Thus, the United Nations has chosen not to be a leader in international affairs. FISCAL IMPACT No fiscal impact to the General Fund. Contact Name: Rep. R.
