|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1019 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO LICENSE FEES FOR THE PRACTICE OF LAW; AMENDING SECTION 3-409, 3 IDAHO CODE, TO STRIKE OBSOLETE VERBIAGE, TO CORRECT A DESIGNATION, TO 4 INCREASE THE MAXIMUM AMOUNT OF A CERTAIN ASSESSMENT IMPOSED ON MEMBERS OF 5 THE IDAHO STATE BAR AND TO MAKE TECHNICAL CORRECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 3-409, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 3-409. LICENSE FEES AND APPROPRIATIONS. Every person practicing, or hold- 10 ing himself out as practicing law within this state, or holding himself out to 11 the public as a person qualified to practice or carry on the calling of a law- 12 yer within this state, except state and United States judges of the courts of 13 record within this state, shall, prior to so doing and no later than February 14 1 of each year pay to the board of commissioners of the Idaho state bar as a 15 license fee the following amounts: 16For the year 2000 and each year thereafter: For the calendar year of17admission to the practice of law in the state of Idaho if admitted prior to18July 1: one hundred fifteen dollars ($115); For the calendar year of admission19to the practice of law in the state of Idaho if admitted after July 1: sixty-20five dollars ($65.00); Each year for the next three (3) calendar years follow-21ing the calendar year of admission: two hundred thirty dollars ($230); Each22year after the third full year of admission three hundred fifteen dollars23($315); Each year following the calendar year of the lawyer's seventy-second24birthday: fifty-five dollars ($55.00); Affiliate members for each calendar25year one hundred twenty dollars ($120).26For the year 2003 and each year thereafter:For the calendar year of 27 admission to the practice of law in the state of Idaho if admitted prior to 28 July 1: one hundred forty dollars ($140); For the calendar year of admission 29 to the practice of law in the state of Idaho if admitted after July 1: ninety 30 dollars ($90.00); Each year for the next three (3) calendar years following 31 the calendar year of admission: two hundred fifty-five dollars ($255); Each 32 year after the third full year of admission: three hundred forty dollars 33 ($340); Each year following the calendar year of the lawyer's seventy-second 34 birthday: fifty-five dollars ($55.00); Affiliate members for each calendar 35 year: one hundred twenty dollars ($120). 36 The moneys thus collected, together with other revenues shall be adminis- 37 tered under the direction of the board of commissioners of the Idaho state bar 38 for the purpose of administering the Idaho state bar, encouraging local bar 39 associations, promoting legal education seminars, fostering relations between 40 the public and the bar and for the purpose of establishing and maintaining a 41 clients'securityassistance fund which shall be administered by the Idaho 42 state bar commissioners under rules approved by the supreme court, provided 43 that the clients'securityassistance fund shall be funded by assessment of 2 1 the members of the Idaho state bar not to exceedtentwenty dollars ($120.00) 2 per member per year, independent of the license fee. All moneys received and 3 expended by the commissioners of the Idaho state bar shall be audited annually 4 by a certified public accountant.
STATEMENT OF PURPOSE RS 12585 This bill makes two changes concerning what is now known as the Idaho State Bar s "Client Security Fund." The Fund is a trust fund, collected from Idaho State Bar members on an annual basis, for the purpose of reimbursing claimants for losses caused by the dishonest conduct of lawyers. Idaho Code 3-409 currently permits the assessment of lawyers of up to $10 per year for the Fund. This bill would increase the amount that can be assessed to $20 per year. The bill also changes the name of the Fund to the "Clients Assistance Fund." Finally, the bill deletes obsolete language about license fee amounts from past years. It does not change the level of license fees; it merely performs housekeeping language changes stemming from an increase passed in the 2002 session. FISCAL IMPACT There is no fiscal impact to the State as the Fund is a self- contained trust fund that uses no general fund money.
